Recorded as received. <br />ORDINANCE NO. 1714 <br />SERIES 2016 <br />AN ORDINANCE APPROVING THE VACATION OF AN EASEMENT WITHIN LOT 5, <br />COLORADO TECHNOLOGY CENTER FILING NO. 2 SUBDIVISION <br />WHEREAS, by the attached Easement Deed recorded in the Office of the Boulder <br />County Clerk and Recorder on July 30, 2007 at Reception No. 2872419, there was <br />dedicated to the City various utility easements on Lot 3, 4, 5, and 16, Colorado <br />Technology Center Filing No. 2 Subdivision, in the location further described in Exhibit A <br />attached hereto and incorporated herein by this reference ("Easements "); and <br />WHEREAS, the Owner of Lot 3, 4, 5, and 16, Colorado Technology Center Filing <br />No. 2 Subdivision, who intends to develop said Lot under a single planned unit <br />development plan, has requested vacation of an Easement; and <br />WHEREAS, the City Council finds and determines that the Easement for which <br />vacation is requested is not and will not be needed for any public purposes and will not be <br />needed for any City utility or drainage purposes; and <br />WHEREAS, the City Council finds and determines that the Easement for which <br />vacation is requested is not being used or held for park purposes or for any other <br />governmental purposes; and <br />WHEREAS, the City Council desires to approve the application and vacate the <br />City's interests in the Easement for which vacation is requested; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The City hereby approves the vacation of an easement on Lot 5, <br />Colorado Technology Center Filing No. 2 Subdivision, which easement herein vacated is <br />in the location further described in Exhibit A attached hereto and incorporated herein by <br />this reference ("the Easements "). <br />Section 2. No other easements for public utilities per Colorado Technology <br />Center Filing No. 2 Subdivision shall be deemed altered or amended by virtue of this <br />ordinance. <br />Section 3. All other ordinances or portions thereof inconsistent or in conflict with <br />this ordinance or any portion hereof are hereby repealed to the extent of such <br />inconsistency or conflict. <br />Section 4.' The Mayor and City Manager, or either of them, is authorized to <br />execute such additional documents as may be necessary to evidence the vacation of the <br />Easements herein vacated, including but not execution of quit claim deeds.
