ORDINANCE NO. 1711 <br />SERIES 2016 <br />AN ORDINANCE APPROVING A REZONING OF A PARCEL OF LAND LOCATED AT <br />1125 PINE STREET FROM CITY OF LOUISVILLE COMMERCIAL COMMUNITY (CC) <br />TO MIXED -USE RESIDENTIAL (MU -R) AND RESIDENTIAL MEDIUM DENSITY (R- <br />M) AND AMENDING THE BOUNDARIES OF THE OLD TOWN OVERLAY DISTRICT <br />IN CONNECTION THEREWITH <br />WHEREAS, Patrick V. Dee is the owner of certain real property totaling approximately <br />0.36 acres located at 1125 Pine Street within the Highway 42 Revitalization Area and the legal <br />description of which is attached hereto as Exhibit A (the "Property "); and <br />WHEREAS, the landowner of said Property, has submitted to the City Council of the City <br />of Louisville a request to approve a rezoning of the Property from Commercial Community (CC) <br />to Mixed -Use Residential (MU -R) and Residential Medium Density (R -M); and <br />WHEREAS, the Louisville Planning Commission has held a public hearing on the <br />proposed rezoning and has forwarded a recommendation to the City Council, and the City <br />Council has duly considered the Commission's recommendation; and <br />WHEREAS, the City Council has reviewed the proposed rezoning and found it to comply <br />with comprehensive plan, Louisville zoning regulations and other applicable sections of the <br />Louisville Municipal Code; and <br />WHEREAS, the City Council finds the request complies with the Highway 42 <br />Revitalization Area Land Use Plan Exhibit referenced in Section 17.14.090 of the Louisville <br />Municipal Code; and <br />WHEREAS, the City Council has held a public hearing on the proposed rezoning and has <br />provided notice of the public hearing as provided by law; and <br />WHEREAS, no protests were received by the City pursuant to C.R.S. § 31 -23 -305; and <br />WHEREAS, the Mixed -Use Residential (MU -R) and Residential Medium Density (R -M) <br />zoning classifications for the Property are consistent with the City of Louisville comprehensive <br />plan, Louisville zoning regulations and other applicable sections of the Louisville Municipal <br />Code; and <br />WHEREAS, the City Council previously adopted Ordinance No. 1195, Series 1995, <br />which established the Old Town overlay zone district and adopted regulations pertaining to said <br />area for the purpose of maintaining the existing character of Old Town; and <br />WHEREAS, in connection with this rezoning request, the City Council desires to amend <br />the current boundaries of the Old Town overlay district to include Lot 2 of the Property within <br />such overlay district and to codify the legal description of the Old Town overlay district. <br />Ordinance No. 1711, Series 2016 <br />Page 1 of 6 <br />
