RESOLUTION NO. 13 <br />SERIES 2016 <br />A RESOLUTION APPROVING THE 9557 PARADISE LANE AMENDMENT TO THE <br />SOUTHEAST BOULDER COUNTY, SOUTH 96TH STREET, DILLON ROAD AND US <br />287 AREA COMPREHENSIVE DEVELOPMENT PLAN INTERGOVERNMENTAL <br />AGREEMENT <br />WHEREAS, the City of Louisville, City of Lafayette, City and County of Broomfield <br />and County of Boulder (the "Parties ") have entered into to the Southeast Boulder County, <br />South 96th Street, Dillon Road and US 287 Area Comprehensive Development Plan <br />Intergovernmental Agreement, dated February 18, 1999, as amended (hereinafter the <br />"Plan "); and <br />WHEREAS, the Parties entered into the Plan to plan for and regulate the use of <br />the lands within the Plan area through joint adoption of a mutually binding and <br />enforceable comprehensive development plan; and <br />WHEREAS, the Rock of Panama City, Inc , the owner of Assessor's parcel <br />number 157520000004, desires to construct a 5,000 square foot church on the <br />Southwest corner of such parcel, which use was not specifically addressed in the <br />original Plan or amendments thereto; and <br />WHEREAS, the City Council has determined that it is appropriate to amend the <br />Plan to accommodate church use on the parcel, with amendments to Section 4.16 of <br />Exhibit A (Text Portion) of the Plan intended to mitigate the impact of such use upon the <br />objectives of the Plan; and <br />WHEREAS, there has been proposed for such purpose an amendment to the <br />Plan entitled the "9557 Paradise Lane Amendment to Southeast Boulder County, South <br />96th Street, Dillon Road and US 287 Area Comprehensive Development Plan <br />Intergovernmental Agreement" (hereinafter the "Amendment "), a copy of which is <br />attached hereto; and <br />WHEREAS, the City is authorized to execute the proposed Amendment pursuant <br />to law, including without limitation C.R.S. § 29 -20 -101 et seq., which authorizes the <br />parties to the Plan to cooperate and contract with each other for the purpose of planning <br />and regulating the development of land by means of a comprehensive development plan; <br />and <br />WHEREAS, pursuant to C.R.S. § 29 -20 -105, the City Council has held a duly - <br />noticed public hearing on the proposed Amendment; and <br />WHEREAS, the City Council by this Resolution desires to approve the Amendment <br />and authorize its execution; <br />Resolution No 13, Series 2016 <br />Page 1 of 2 <br />
