RESOLUTION NO. 17 SERIES 2008 A RESOLUTION APPROVING A SPECIAL REVIEW USE (SRU) TO AUTHORIZE THE RELOCATION OF FAIRVIEW MONTESSORI SCHOOL FROM 733 JEFFERSON AVENUE TO 1501 JEFFERSON AVENUE. WHEREAS, there has been submitted to the Louisville City Council, a request for approval of a Special Review Use (SRU) to authorize Fairviiew Montessori School to be located at 1501 Jefferson Avenue; and WHEREAS, all materials related to the a Special Review Use have been reviewed by City Staff and the Planning Commission and found, to be in compliance with the Louisville zoning ordinances, related policies and previous approvals; and WHEREAS, after a duly noticed public hearing concerning said Special Review Use on April 10, 2008, where evidence and testimony were entered into the public record, including the staff report dated April 10, 2008, the Planning Commission recommended approval to the City Council, with the following conditions: 1. The SRU site plan shall be revised to incorporate atrash/recycling area be constructed on the site that will adequately serve this use. 2. The SRU site plan shall be revised to incorporate two additional staff parking spaces on the existing concrete drive that is located near the existing detached garage. 3. The SRU site plan shall be revised to incorporate a Ei foot around the entire outside play area. That portion of the fence adjacent and running parallel to the ditch shall be a solid cedar fence. 4. The SRU site plan shall be revised to reflect that the west side of Jefferson street along the frontage of the subject parcel should be signed for "pick up and drop off only" to allow for the western side of Jefferson Avenue to remain free and clear for queuing. 5. The Special Review Use is granted to the applicant only and is for a maximum of 60 students; and WHEREAS, City Council has reviewed the application, including the recommendation of the Planning Commission and that the application should be approved, with the following conditions 1. The SRU site plan shall be revised to incorporate two additional staff parking spaces on the existing concrete drive that is located near the existing detached garage. 2. The SRU site plan shall be revised to reflect that the north boundary of the outside play area will be fenced with a 6 foot, solid fence adjacent and running parallel to the ditch. The east, west, and south boundaries of the outside play area will be fenced by a 5' high, chain link fence.
