RESOLUTION NO. 17 <br />SERIES 2008 <br />A RESOLUTION APPROVING A SPECIAL REVIEW USE (SRU) TO AUTHORIZE <br />THE RELOCATION OF FAIRVIEW MONTESSORI SCHOOL FROM 733 JEFFERSON <br />AVENUE TO 1501 JEFFERSON AVENUE. <br />WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a Special Review Use (SRU) to authorize Fairviiew Montessori School to be located <br />at 1501 Jefferson Avenue; and <br />WHEREAS, all materials related to the a Special Review Use have been reviewed by <br />City Staff and the Planning Commission and found, to be in compliance with the Louisville <br />zoning ordinances, related policies and previous approvals; and <br />WHEREAS, after a duly noticed public hearing concerning said Special Review Use <br />on April 10, 2008, where evidence and testimony were entered into the public record, <br />including the staff report dated April 10, 2008, the Planning Commission recommended <br />approval to the City Council, with the following conditions: <br />1. The SRU site plan shall be revised to incorporate atrash/recycling area be constructed on <br />the site that will adequately serve this use. <br />2. The SRU site plan shall be revised to incorporate two additional staff parking spaces on <br />the existing concrete drive that is located near the existing detached garage. <br />3. The SRU site plan shall be revised to incorporate a Ei foot around the entire outside play <br />area. That portion of the fence adjacent and running parallel to the ditch shall be a solid <br />cedar fence. <br />4. The SRU site plan shall be revised to reflect that the west side of Jefferson street along <br />the frontage of the subject parcel should be signed for "pick up and drop off only" to <br />allow for the western side of Jefferson Avenue to remain free and clear for queuing. <br />5. The Special Review Use is granted to the applicant only and is for a maximum of 60 <br />students; and <br />WHEREAS, City Council has reviewed the application, including the recommendation <br />of the Planning Commission and that the application should be approved, with the following <br />conditions <br />1. The SRU site plan shall be revised to incorporate two additional staff parking spaces on <br />the existing concrete drive that is located near the existing detached garage. <br />2. The SRU site plan shall be revised to reflect that the north boundary of the outside play <br />area will be fenced with a 6 foot, solid fence adjacent and running parallel to the ditch. <br />The east, west, and south boundaries of the outside play area will be fenced by a 5' high, <br />chain link fence. <br />
