RESOLUTION NO. a8 SERIES 2008 A RESOLUTION APPROVING A PURCHASE CONTRACT TO BUY AND SELL REAL ESTATE FOR ACQUISITION OF CERTAIN RIGH7C-OF-WAY AND A TEMPORARY CONSTRUCTION EASEMENT REQUIRED FOR THE DILLON ROAD PROJECT WHEREAS, the City of Louisville has previously authorized and approved the Dillon Road Project for reconstruction of, and drainage and road~~vay improvements on and adjacent to, Dillon Road (hereinafter referred to as the "Project"); and WHEREAS, the Project is for a public use and purpose; and WHEREAS, it is necessary to acquire for the Project the property more particularly described in Exhibits A-1 and B-1 to the agreement accompanying this Resolution (hereinafter "the Property"); and WHEREAS, a Purchase Contract to Buy and Sell Real Estate (the "Purchase Contract") has been proposed for the City's acquisition of the Property; and WHEREAS, the City has also identified the need for temporary construction easement over a portion of the property more particularly described in Exhibits A-2 and B-2 to the agreement accompanying this Resolution; and WHEREAS, a Grant of a Temporary Construction Easement (the "Grant of Easement") has been proposed for the City's acquisition of such easement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. The proposed Purchase Contract between the City of Louisville and Joel A. Self, for the City's acquisition of the Property which is described in Exhibits A-1 and B-1 to such Purchase Contract, is hereby approved in essentially the same form as the copy of such Purchase Contract accompanying this Resolution. 2. The proposed Grant of Easement between the City of Louisville and Joel A. Self, for a temporary construction easement over the property which is described in Exhibits A-2 and B-2 to such Grant of Easement, is hereby approved in essentially the same form as the copy of such Grant of Easement accompanying this Resolution. 3. The Mayor is authorized to execute the Purchase Contract and Grant of Easement, except that the Mayor is hereby granted the authority to negotiate and approve such revisions to said Purchase Contract and Grant of Easement as the Mayor determines are necessary or desirable for the protection of the City, so long as the essential terms and conditions of the Purchase Contract and Grant of Easement are not altered.
