RESOLUTION N0.20 SERIES 2008 A RESOLUTION APPROVING AN AMENDMENT TO CONSERVATION EASEMENTS IN GROSS AND A TEMPORARY CONSTRUC7CION EASEMENT OVER THE TRILLIUM OPEN SPACE PROPERTY FOR THE DILLON ROAD PROJECT WHEREAS, the City of Louisville ("City") and the County of Boulder ("County") each own a 50% undivided interest in fee simple title to a parcel of real property located in Boulder County, Colorado known as the Trillium Property; and WHEREAS, the Trillium Property is subject to reciprocal Deeds of Conservation Easement in Gross from the City to the County and from the County to the City, dated September 13, 2001, and recorded October 1, 2001, at Reception Nos. 2202385 and 2202386, respectively, in the Office of the Boulder County Clerk and Recorder (the "Conservation Easements"); and WHEREAS, pursuant to the 1999 intergovernmental agreement (IGA) for purchase of the Trillium Property and Ordinance No. 1531, Series 2008, the City is acquiring the County's 50% undivided interest in fee simple title to a 2.13-acre portion of the Trillium Property for right- of-way for the Dillon Road Project; and WHEREAS, pursuant to the IGA, the right-of--way is to be released from the Conservation Easements; and WHEREAS, the City and County have also identified the need for temporary construction easement over a portion of the Trillium Property for the Dillon Road Project; and WHEREAS, for such purposes, there have been proposed an Amendment to Deeds of Conservation Easement in Gross and a Temporary Construction Easement Agreement; and WHEREAS, the City by this resolution desires to approve the forms of such documents, authorize their execution, and authorize other action in relation thereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. The Proposed Amendment to Deeds of Conservation Easement in Gross between the City of Louisville and the County of Boulder, for amendment of the existing Trillium Property Conservation Easements (the "Amendment") is hereby approved in essentially the same form as the copy of such Amendment accompanying this Resolution. 2. The Proposed Temporary Construction Easement Agreement between the City of Louisville and the County of Boulder, for construction purposes related to the Dillon Road Project (the "Easement"), is hereby approved in essentially the same form as the copy of such Easement accompanying this Resolution.
