RESOLUTION NO.2l'~ <br />SERIES 2008 <br />A RESOLUTION APPROVING A FINAL PUD DEVELOPMENT PLAN TO ALLOW FOR A <br />SECOND FLOOR ADDITION TO THE EXISTING STRUCTURE LOCATED AT 916 MAIN <br />STREET. <br />WHEREAS, there has been submitted to the Louisville (:ity Council, a request for approval of a <br />Final PUD Development Plan to allow for a second floor addition to the existing structure located at 916 <br />Main Street; and <br />WHEREAS, all materials related to the final PUD development plan have been reviewed by City <br />Staff and the Planning Commission and found, to be in compliance with the Louisville zoning ordinances, <br />subdivision regulations, the Downtown Design Handbook and Downtown Framework Plan, related <br />policies and previous approvals; and <br />WHEREAS, after a duly noticed public hearing concerniing said Final PUD development plan on <br />April l 0, 2008, where evidence and testimony were entered into the public record, including the staff <br />report dated April 10, 2008, the Planning Commission recommended approval to the City Council, with <br />the following three conditions: <br />L In lieu of providing the required parking spaces, the applicant must provide the City a payment in- <br />lieu fee of $3,600 per required parking space. Based upon a total of four spaces a payment of <br />$14,400 should be received prior to issuance of building permit. <br />2. The applicant shall include atrash/recycling container on site. <br />3. The PUD shall be modified to add a note which prohibits tenant finish of the existing basement. <br />WHEREAS, City Council has reviewed the application, including the recommendation of the <br />Planning Commission and finds that the revised documents are in full compliance with the conditions of <br />the Planning Commission and that the application should be approved, with three conditions: <br />1.
