RESOLUTION NO.:Z4 <br />SERIES 2008 <br />A RESOLUTION APPROVING A FINAL SUBDIVISION PLAT AND A FINAL <br />PLANNED UNIT DEVELOPMENT (PUD) PLAN FOR THE TAKODA <br />DEVELOPMENT <br />WHEREAS, there has been submitted to the Louisville City Council an <br />application for approval of a final subdivision plat and final planned unit development (PUD) <br />plan for the proposed Takoda development on a 64-acre parcel of land located in northeast <br />Louisville; and, <br />WHEREAS, all materials related to the final subdivision plat and final planned unit <br />development (PUD) plan have been reviewed by City Staff and the Planning Commission and <br />found, subject to conditions, to be in compliance with the Louisville zoning ordinances, <br />subdivision regulations, related policies and. previous approvals; and <br />WHEREAS, the City Staff has reviewed the information submitted and found that, <br />subject to conditions, the application complies with the Louisville zoning and subdivision <br />regulations and other applicable sections of the Louisville Municipal Code; and, <br />WHEREAS, after duly noticed public hearing where evidence and testimony was entered <br />into the record, including without limitation the findings in the Louisville Planning Commission <br />Staff Reports dated March 20, 2008, and April 17, 2008, the City of Louisville Planning <br />Commission approved a resolution to forward a recommendation of approval, with conditions to <br />the City Council; and, <br />WHEREAS, City Council has reviewed the application, including the recommendation <br />of the Planning Commission and finds that said final subdivision plat and final planned unit <br />development (PUD) plan should be approved, subject to~ the following conditions: <br />Prior to or in conjunction with the recordation of final documents the applicant shall <br />enter into a subdivision agreement..7'he terms and provisions of the subdivision <br />agreement shall conclude the following requirements of the applicant: <br />a. Compliance with the City of Louisville and City of Lafayette IGA for the <br />development of Paschal Dive. <br />b. Securing the applicant's share of the costs for installing the traffic signal to be <br />located at Paschal Drive and Hwy 42. <br />c. Ditch Company approval for piping a portion of the Davidson Higlzline Ditch. <br />d. Approval of the required civil report and design for the sanitary lift station. <br />e. Identification of the extent of'applicant credit for the completion of public <br />improvement obligations as required by the North Louisville Annexation <br />Agreements. <br />
