RESOLUTION NO. 23 <br />SERIES 2016 <br />A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH <br />THE COLORADO DEPARTMENT OF TRANSPORTATION TO DELINEATE <br />CONSTRUCTION AND MAINTENANCE RESPONSIBILITIES FOR THE US 36 <br />BIKEWAY CONSTRUCT_ ED AS PART OF THE US 36 MANAGED LANE/BUS RAPID <br />TRANSIT PROJECT <br />WHEREAS, the Colorado Department of Transportation ( "CDOT ") and the Colorado <br />High Performance Transportation Enterprise ( "HPTE "), a government -owned business within <br />CDOT, are undertaking to construct, design, build, operate and finance the project identified as the <br />US 36 Managed Lane/Bus Rapid Transit Project (hereinafter "the Project "); and <br />WHEREAS, the US 36 EIS Record of Decision signed in December 2009 provides the <br />Project will include a bikeway facility connecting Boulder and Denver, and maintenance of <br />bikeway will be the responsibility of the respective local jurisdictions through intergovernmental <br />agreement; and <br />WHEREAS, an intergovernmental agreement has been proposed between the City and <br />CDOT to delineate maintenance and other responsibilities for that portion of the US 36 bikeway <br />within the City; and <br />WHEREAS, the City is authorized by law to enter into such an intergovernmental <br />agreement, and the City Council finds and determines that execution of the proposed agreement is <br />in the best interest of the City and its citizens; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />1. The City Council hereby approves that certain Intergovernmental Agreement <br />between the City of Louisville and the Colorado Department of Transportation for delineation of <br />maintenance and other responsibilities for the portion of the US 36 bikeway within the City (the <br />"IGA "), in substantially the same form as the copy of such IGA accompanying this Resolution. <br />2. The Mayor is hereby authorized to execute the IGA on behalf of the City Council of <br />the City of Louisville, except that the Mayor is hereby further authorized to negotiate and approve <br />such revisions to the IGA as the Mayor determines are necessary or desirable for the protection of <br />the City, so long as the essential terms and conditions of the IGA are not altered. <br />3. The Mayor, City Manager and City Staff are hereby authorized and directed to do all <br />things necessary on behalf of the City to perform the obligations of the City under the IGA, <br />Resolution No. 23, Series 2016 <br />Page 1 of 2 <br />
