03555251 1110412016 11:54AM <br />RF: $26.00 DF: $0.00 Page: 1 of 4 <br />Electronically recorded In Boulder County Colorado Recorded as received <br />ORDINANCE NO. 1728 <br />SERIES 2016 <br />AN ORDINANCE APPROVING THE VACATION OF A 20 -FOOT WIDE IJTILITY <br />EASEMENT ON LOT 1A, CENTENNIAL VALLEY PARCEL H, THIRD FILING <br />WHEREAS, by the plat of Centennial Valley Parcel H, Third Filing, recorded in the Office <br />of the Boulder County Clerk and Recorder on March 7,1996 at Reception No. 1589632, there was <br />dedicated to the City a 20 foot utility easement on Lot 1 A m the location further described in <br />Exhibit A attached hereto and incorporated herein by this reference ("the 20 foot Easement"); and <br />WHEREAS, the Centennial Valley Parcel H, McCaslin Marketplace (Retail, Inc) Final <br />Planned Unit Development ("the PUD"), recorded in the Office of the Boulder County Clerk and <br />Recorder on September 14, 2015 at Reception No. 03473447, includes a condition that the <br />property owner, McCaslin Retail, LLC, relocate the water main outside of the 20 foot Easement <br />and to dedicate to the City a new easement for the relocated water main; and <br />WHEREAS, McCaslin Retail, LLC, the owner of Lot 1A, Centennial Valley Parcel H, <br />Third Filing has relocated the water main in compliance with the PUD, abandoned the water <br />main in the 20 foot Easement and requests vacation of the 20 foot Easement; and <br />WHEREAS, an easement for the relocated water main has been granted to the City by an <br />Exclusive Utility Easement Deed, recorded in the Office of the Boulder County Clerk and <br />Recorder on August 17, 2016 at Reception No. 03537784; and <br />WHEREAS, the City Council finds and determines that the 20 foot Easement for which <br />vacation is requested is not and will not be needed for any public purposes and will not be needed <br />for any City utility purposes; and . <br />WHEREAS, the City Council finds and determines that the 20 foot Easement for which <br />vacation is requested is not being used or held for park purposes or for any other governmental <br />purposes; and <br />WHEREAS, the City Council desu'es to approve the application and vacate the City's <br />interests in the 20 foot Easement for which vacation is requested; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The City hereby approves the vacation of that certain 20 -foot wide utility <br />easement located on Lot IA, Centennial Valley Parcel H, Third Filing, which easement herein <br />vacated is in the location further described in Exhibit A attached hereto and incorporated herein by <br />this reference ("the 20 foot Easement"). <br />Section 2.
