ORDINANCE NO. 1730 <br />SERIES 2016 <br />AN ORDINANCE APPROVING AN AMENDMENT TO THE NORTH END GENERAL <br />DEVELOPMENT PLAN (GDP) TO TRANSFER 17 RESIDENTIAL UNITS FROM <br />PLANNING AREA 4 TO PLANNING AREA 1 AND REDUCE THE COMMERCIAL <br />SPACE TO 40,000 SQUARE FEET IN PLANNING AREA 1 <br />WHEREAS, the Ridgeline Development Corporation is the owner of certain real property <br />totaling approximately 4 56 acres, which property is designated as a portion of the North End <br />Subdivision property and the legal description of which is attached hereto as Exhibit A (the <br />"Property"), and <br />WHEREAS, the Property is currently zoned Planned Community Zone District — <br />Commercial (PCZD — C) and, permitted uses are set forth on the existing PCZD general <br />development plan; and <br />WHEREAS, the owner has submitted to the City a request for approval of an amended <br />PCZD General Development Plan for the Property, which amended Plan is entitled the North End <br />General Development Plan, 3`d Amendment and a copy of which is attached hereto as Exhibit A <br />(the "North End GDP 3'd Amendment"); and <br />WHEREAS, the North End GDP 3'd Amendment shall serve to identify the zoning, <br />permitted uses and development for the Property and shall serve as the PCZD General <br />Development Plan for the Property, in accordance with Title 17 of the Louisville Municipal Code; <br />and <br />WHEREAS, the Louisville Planning Commission has held a public hearing on the <br />proposed North End GDP 3111 Amendment for the Property and has forwarded a recommendation <br />to the City Council to approve the North End GDP 31d Amendment; and <br />WHEREAS, the City Council has duly considered the Commission's recommendation, and <br />WHEREAS, the City Council has held a public heanng on the proposed North End GDP <br />3`d Amendment and has provided notice of the public hearing as provided by law; and <br />WHEREAS, no protests were received by the City pursuant to C.R.S §31-23-305; and <br />WHEREAS, the North End GDP 3`d Amendment, subject to the conditions herein, is <br />consistent with the City of Louisville 2013 Citywide Comprehensive Plan; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1.
