RESOLUTION NO. 14 <br />SERIES 2017 <br />A RESOLUTION APPROVING A PLANNED UNIT DEVELOPMENT (PUD) <br />AMENDMENT AND SPECIAL REVIEW USE (SRU) AMENDMENT TO ALLOW FOR A <br />MODIFICATION OF INTERIOR AND EXTERIOR SPACES AT 817 MAIN STREET <br />WHEREAS, there has been submitted to the Louisville City Council an application <br />for approval of a Planned Unit Development (PUD) amendment and Special Review Use <br />(SRU) amendment to allow for modifications of the interior and exterior spaces at 817 <br />Main Street at S 5ft Lot 10 & N 20ft Lot 11, Block 5, Louisville Old Town; and <br />WHEREAS, the City Staff has reviewed the information submitted and found that, <br />subject to conditions, the application complies with the Louisville zoning and subdivision <br />regulations and other applicable sections of the Louisville Municipal Code, and <br />WHEREAS, after a duly noticed public heanng on February 9, 2017, where <br />evidence and testimony were entered into the record, including the findings in the <br />Louisville Planning Commission Staff Report dated February 9, 2017, the Planning <br />Commission recommends approval of the PUD Amendment to the City Council with <br />conditions; and <br />WHEREAS, City Council has reviewed the application, including the <br />recommendation of the Planning Commission, and finds that it complies with Chapter <br />17.28 210 of the Louisville Municipal Code; <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Louisville, Colorado does hereby approve a Planned Unit Development (PUD) amendment <br />and Special Review Use (SRU) amendment to allow for modifications of the interior and <br />exterior spaces at 817 Main Street with the following conditions. <br />1. Prior to issuance of the building permit, the applicant shall enter into an agreement <br />with the City to address safety and maintenance of the staircase within the public <br />right-of-way. <br />2 Prior to certificate of occupancy, the applicant shall comply with all requirements of <br />the amended conservation easement, including the interpretive signage. <br />3. Prior to recordation, the applicant shall amend the plan to include the following <br />notes: <br />A. Nighttime hours of operation for the outdoor patio shall not extend past 12 am. <br />B. Patio lighting shall include down -cast soffit lighting with full cutoff fixtures with a <br />maximum light level of 1500 lumens per light and string -lights with a maximum <br />level of 900 lumens per lamp <br />C. There will be no dancing or live music permitted in the open deck area. <br />D. The businesses shall provide sidewalk dining in the appropriate seasons to <br />maintain street level pedestrian activities. <br />Resolution No 14, Series 2017 <br />Page 1 of 2 <br />
