ORDINANCE NO. 1734 SERIES 2017 AN ORDINANCE APPROVING THE VACATION OF A 10-FOOT WIDE DRAINAGE EASEMENT ON LOTS 1, 16, AND 17, BLOCK 2, COLORADO TECHNOLOGICAL CENTER,FIRST FILING WHEREAS, by the plat of Colorado Technological Center, First Filing, recorded in the Office of the Boulder County Clerk and Recorder on September 27, 1979 at Reception No. 361999, there was dedicated to the City a 10-foot drainage easement on Lots 1, 16 and 17 in the location further described in Exhibit A attached hereto and incorporated herein by this reference ("the 10- foot Easement");and WHEREAS, the Innovative Openings Final Planned Unit Development ("the PUB"), approved by City Council on December 20, 2016 under Resolution No. 70, Series 2416, includes a condition that the property owner, PF Investments, LLC, vacate the 10-foot drainage easement prior to the issuance of a building permit; and WHEREAS, the City Council finds and determines that the 10-foot Easement for which vacation is requested is not and will not be needed for any public purposes and will not be needed kr any City utility purposes;and WHEREAS, the City Council finds and determines that the 10-foot Easement for which vacation is requested is not being used or held for park purposes or for any other governmental purposes;and WHEREAS, the City Council desires to approve the application and vacate the City's interests in the 10-foot Easement for which vacation is requested; NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE,COLORADO: Section 1. The City hereby approves the vacation of that certain I0-foot wide drainage easement located on Lots 1, 16 and 17,Block 2,Colorado Technological Center, First Filing, which easement herein vacated is in the location further described in Exhibit A attached hereto and incorporated herein by this reference("the 10-foot Easement"). Section 2. No other easements for public utilities per the plat of Colorado Technological Center, First Filing shall be deemed altered or amended by virtue of this ordinance. Section 3. All other ordinances or portions thereof inconsistent or in conflict with this ordinance or any portion hereof are repealed to the extent of such inconsistency or conflict. Section 4.
