RESOLUTION NO. 20 SERIES 2017 A RESOLUTION CONSENTING TO THE INCLUSION OF PROPERTY WITHIN THE COLORADO TECH CENTER METROPOLITAN DISTRICT WHEREAS, a petition for the organization of the Colorado Tech Center Metropolitan Distnct ("the District") was approved by the City of Louisville ("the City") by City Council Resolution No. 13, Series 1983, adopted March 15, 1983; and WHEREAS, the Boulder County Distnct Court issued an Order and Decree creating the District on July 12, 1983 after finding the Distnct was duly organized pursuant to Title 32 of the Colorado Revised Statutes following approval of the organization of the District by the eligible electors thereof; and WHEREAS, the District received a Petition for Inclusion dated October 11, 2016 ("the Petition") requesting inclusion in the Distnct of certain property legally described as follows. Southeast One -Quarter of Section 16, Township 1 South, Range 69 West of the Sixth Principal Mendian, less part to Dillon Road Right -of -Way pursuant to the General Warranty Deed recorded with the Boulder County Clerk and Recorder on July 1, 2008 at Reception No 2940622, City of Louisville, Boulder County, Colorado, also identified as Boulder Country Parcel Number 157516000012, with a mailing address of 10101 Dillon Road, Louisville (the "Property"); WHEREAS, the District published a Notice of Inclusion and held a public hearing on the Petition on November 11, 2016; and WHEREAS, after said hearing, the District adopted a Resolution to Approve Petition for Inclusion ("the Resolution") making certain findings and ordering inclusion of the Property within the District, and further providing that a motion and order for inclusion of the Property shall not be filed with the District Court of Boulder County unless and until any required City approvals for the inclusion are sought and obtained; and WHEREAS, the City Council of the City has reviewed the Petition, Resolution, Notice of Inclusion and other information provided by and on behalf of the Distnct and by this Resolution desires to provide City consent to the inclusion of the Property in the District; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. The foregoing recitals are hereby incorporated in and made a part of this Resolution 2 Based upon the information provided by and on behalf of the District, the City Council of the City of Louisville hereby consents to the Distnct's inclusion witlun its boundaries of the Property as defined and legally described in the above recitals Such inclusion of the Property within the District is subject to all applicable law.
