ORDINANCE NO. 1736 <br />SERIES 2017 <br />AN ORDINANCE AMENDING TITLE 4, TITLE 10 AND TITLE 14 OF THE <br />LOUISVILLE MUNICIPAL CODE REGARDING ELECTRICAL ASSISTED <br />BICYCLES <br />WHEREAS, the City of Louisville is a Colorado home rule municipal corporation duly <br />organized and existing under laws of the State of Colorado and the City Charter; and <br />WHEREAS, the City has previously adopted Titles 4, 10 and 14 of the Louisville <br />Municipal Code, concerning bicycle use in the City; and <br />WHEREAS, these Titles do not expressly permit the use of electrical assisted bicycles <br />nor do they establish regulations concerning their use; and <br />WHEREAS, the City Council desires to reduce barriers to bicycle riding for as many <br />people as possible, and promote bicycle commuting; and <br />WHEREAS, the City Council desires to amend Title 4, Title 10 and Title 14 of the <br />Louisville Municipal Code to allow the use of and establish regulations for electrical assisted <br />bicycles throughout the City, <br />NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />Section 1. The following sections and subsections in Title 4 of the Louisville <br />Municipal Code are hereby amended to read as follows (words added are underlined): <br />Sec. 4.01.020. - Definitions. <br />F. Electrtcal assisted bicycle shall mean a vehicle having two (2) tandem <br />wheels or two (2) parallel wheels and one (1) forward wheel, fully operable <br />pedals, an electric motor not exceeding seven hundred fifty (750) watts of power <br />and a top motor -powered speed of twenty (20) miles per hour. <br />Sec. 4.04.101— Scope; prohibitions <br />K. Operate or ride a bicycle or electncal assisted bicycle within any open <br />space, except on officially designated roads and trails and only when those areas <br />are not posted to prohibit such use The director may adopt bicycle and electrical <br />assisted bicycle use restrictions on specific trails or open space areas when such <br />restnctions are necessary for resource protection or safety related issues Such <br />restrictions shall be posted at the trailheads It shall be unlawful for any person to <br />violate the posted restnctions. <br />Ordinance No 1736, Senes 2017 <br />Page 1 of 3 <br />
