RESOLUTION NO. 01 <br />SERIES 2017 <br />A RESOLUTION OVERTURNING THE DECISION THAT <br />THE EXISTING STAIRCASE HEADROOM OF 6' 0" FOR A BASEMENT <br />RENOVATION PROJECT AT 1610 CIRCLE DRIVE DOES NOT COMPLY <br />WITH THE ADOPTED BUILDING CODES OF THE CITY <br />WHEREAS, there has been submitted to the Louisville Building Code Board of <br />Appeals an application for an appeal of a determination by the City's Building Official <br />that a minimum staircase headroom clearance of 6' 6" must be met for a basement <br />renovation project at 1610 Circle Drive; and <br />WHEREAS, the Building Code Board of Appeals originally reviewed the appeal <br />on March 16, 2017 and upheld the determination that a the minimum staircase <br />headroom of 6' 6" is required for the scope of the renovation project; and <br />WHEREAS, pursuant to Article IX, Section 14 of the Building Code Board of <br />Appeals Bylaws, the Building Code Board of Appeals has held a rehearing of the appeal <br />based on a substantial change in facts, which includes additional information provided <br />by the applicant that there was a previous renovation of the basement, identification of <br />adopted building code sections in support of the existing headroom condition, and a <br />determination that modification of the stairs or ceiling are not feasible; and <br />WHEREAS, after evidence and testimony were entered into the record, including <br />the May 18, 2017 analysis provided by the City's Interim Building Official, the Building <br />Code Board of Appeals finds that the existing_ staircase headroom clearance of 6' 0" is <br />allowed to remain by the_City's adopted building codes. <br />NOW THEREFORE, BE IT RESOLVED that the Building Code Board of Appeals of the <br />City of Louisville, Colorado does hereby adopt the findings of the May 18, 2017 analysis <br />provided by the City's Interim Building Official and overturns the decision that the <br />existing 6' 0" staircase headroom clearance at 1610 Circle Drive does not comply with <br />the City's adopted building codes. <br />PASSED AND ADOPTED this 25th day of May, 20 <br />Attest: <br />EI abeth Schettler, Secretary <br />Building Code Board of Appeals <br />By: <br />Peter GeL , Chair <br />Building Code Board of Appeals <br />
