Recorded as received. <br />ORDINANCE NO. 1740 <br />SERIES 2017 <br />AN ORDINANCE APPROVING THE VACATION OF A PORTION OF A 10 -FOOT WIDE <br />MAINTENANCE ACCESS EASEMENT DEDICATED BY THE NORTH END, BLOCK <br />10, SECOND REPLAT <br />WHEREAS, by the plat of North End, Block 10, Second Replat, recorded in the Office of <br />the Boulder County Clerk and Recorder on April 14, 2014 at Reception No 03375076, there was <br />dedicated to the City, under Plat Note 14 of said plat, a 10 -foot wide maintenance access easement <br />beyond the exclusive City utility easements and the access easements on Parcel B in the location <br />further described in Exhibit A attached hereto and incorporated herein by this reference ("the 10 - <br />foot Easement"); and <br />WHEREAS, the North End Block 10 Final Planned Unit Development ("the PUD") 3rd <br />Amendment, approved by City Council on June 13, 2017 under Resolution No 29, Series 2017, <br />includes approval of garage structures over a portion of the 10 -foot Easement; and <br />WHEREAS, the City Council finds and determines that the 10 -foot Easement for which <br />partial vacation is requested is not and will not be needed for the maintenance access or City utility <br />purposes for which it was dedicated or for any public purposes; and <br />WHEREAS, the City Council finds and determines that the 10 -foot Easement for which <br />vacation is requested is not being used or held for park purposes or for any other governmental <br />purposes; and <br />WHEREAS, the City Council desires to approve the application and vacate the City's <br />interests in the 10 -foot Easement for which vacation is requested, as specific in this ordinance, <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The City hereby approves the vacation of those certain portions of the 10 - <br />foot wide maintenance access easement beyond the exclusive City utility easements and the access <br />easements on Parcel B, North End, Block 10, Second Replat in the locations further described in <br />Exhibit A attached hereto and incorporated herein by this reference ("the 10 -foot Easement"), and <br />hereby vacates the City's interest in the 10 -foot Easement. <br />Section 2. No other portions of the 10 -foot wide maintenance access easement, and no <br />easements for public utilities per the plat of North End, Block 10, Second Replat shall be deemed <br />altered or amended by virtue of this ordinance. <br />Section 3. All other ordinances or portions thereof inconsistent or in conflict with this <br />ordinance or any portion hereof are repealed to the extent of such inconsistency or conflict <br />Ordinance No, 1740, Serres 2017 <br />Page 1 of 3 <br />
