ORDINANCE NO. 1741 SERIES 2017 AN ORDINANCE APPROVING THE VACATION OF A 20 -FOOT WIDE DRAINAGE EASEMENT AND A PORTION OF AN ACCESS EASEMENT ON LOTS 2A AND 3A, THE BUSINESS CENTER AT C.T.C. REPLAT F WHEREAS, by the plat of The Busmess Center at C T C Replat F, recorded m the Office of the Boulder County Clerk and Recorder on October 3, 2007 at Reception No 2887397, there was dedicated to the City a 20 -foot drainage easement on Lots 2A and 3A m the location further described in Exhibit A attached hereto and mcorporated hereon by this reference ("the Drainage Easement"), and WHEREAS, by the plat of The Busmess Center at C T C Replat F, recorded in the Office of the Boulder County Clerk and Recorder on October 3, 2007 at Reception No 2887397, there was dedicated to the City an access easement on Lots 2A and 3A m the location further descnbed m Exhibit B attached hereto and incorporated herein by this reference ("the Access Easement"), and WHEREAS, the applicant proposes to amend the fmal Planned Unit Development for the property to allow construction of additional improvements within the Dramage Easement and a portion of the Access Easement, and WHEREAS, the City Council finds and determines that the Drainage Easement for which vacation is requested is not and will not be needed for any public purposes and will not be needed for any City drainage purposes, and WHEREAS, the City Council fmds and determines that the Access Easement for which vacation is requested is not necessary for any City purposes, as the remaining portion of the Access Easement is adequate for City purposes, and WHEREAS, the City Council desires to approve the application and vacate the City's interests m the Drainage Easement and m the portion of the Access Easement for which vacations are requested, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The City hereby approves the vacation of that certain 20 -foot wide drainage easement located on Lots 2A and 3A, The Business Center at C T C Replat F, which easement herein vacated is m the location further described m Exhibit A attached hereto and mcorporated herein by this reference ("the Dramage Easement"), and the City hereby approves the vacation of that certain portion of an access easement located on Lots 2A and 3A, The Business Center at C TC Replat F, which easement herein vacated is m the location further descnbed m Exhibit B attached hereto and incorporated herem by this reference ("the Access Easement") Section 2. No other easements for public utilities per the plat of The Busmess Center at Ordinance No 1741, Series 2017 Page 1 of 6
