Recorded as received. <br />ORDINANCE NO. 1744 <br />SERIES 2017 <br />AN ORDINANCE APPROVING THE VACATION OF PORTIONS OF PINE STREET <br />AND VIA APPIA RIGHT OF WAY DEDICATED BY THE CENTENNIAL VALLEY, <br />SECOND FILING (CORRECTED PLAT) <br />WHEREAS, by the Centennial Valley, Second Filing (Corrected Plat), recorded in the <br />Office of the Boulder County Clerk and Recorder on February 6, 1980 at Reception No 382802, <br />there was dedicated to the City street right of way for Pine Street and Via Appia; and <br />WHEREAS, a Planned Unit Development and Final Subdivision Plat application have <br />been submitted to the City for redevelopment of the City Recreation Center on a portion of <br />Parcel B, Centennial Valley, Second Filing and a parcel of land located in the Southwest Quarter <br />of Section 7, Township 1 South, Range 69 West of the 6th P M , and including certain portions of <br />Pine Street and Via Appia right of way to be vacated, and <br />WHEREAS, the City Council finds and determines that the street right of way for which <br />vacation is requested is not and will not be needed for the development of City streets or any other <br />public purposes requirmg retention of the nght of way to be vacated, <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The City Council hereby approves the vacation of that certam 2.02 acre <br />portion of Pine Street nght of way and those certam 0 78 and 0 29 acre portions of Via Appia nght <br />of way dedicated by the Centennial Valley, Second Filing (Corrected Plat) and legally descnbed <br />and depicted in Exhibit A attached hereto and incorporated herein by this reference ("the street nght <br />of way") <br />Section 2. No other rights of way per the Centennial Valley, Second Filing (Corrected <br />Plat) shall be deemed altered or amended by virtue of this ordinance <br />Section 3. All other ordinances or portions thereof mconsistent or in conflict with this <br />ordinance or any portion hereof are repealed to the extent of such mconsistency or conflict. <br />Section 4. The Mayor and City Manager, or either of them, is authorized to execute <br />such additional documents as may be necessary to evidence the vacation of the street nght of way <br />herein vacated, including but not limited to the execution of quit claim deeds All action heretofore <br />taken m furtherance of the vacation of such street right of way is hereby ratified and confirmed <br />Ordinance No 1744, Series 2017 <br />Page 1 of 7 <br />
