ORDINANCE NO. 1749 <br />SERIES 2017 <br />AN ORDINANCE AMENDING CHAPTER 9.72 OF THE LOUISVILLE MUNICIPAL <br />CODE CONCERNING SIGNAGE IN LIQUOR LICENSED ESTABLISHMENTS <br />WHEREAS, the City previously adopted Section 9 72 060 of the Louisville Municipal <br />Code requirmg liquor licensed estabhshments to post signs prohibiting underage persons unless <br />accompamed by their parents, and <br />WHEREAS, the number and types of businesses obtammg liquor licenses has expanded m <br />recent years to include, among other things, movie theaters, entertamment facilities, sportmg venues <br />and art gallenes, and City Council finds that the signage requirement m Section 9 72 060 is no <br />longer necessary or appropnate, and <br />WHEREAS, the City Council also desires to amend the signage requirements m Section <br />9 72 050 of the Louisville Municipal Code <br />NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />Section 1. Section 9 72 050 of the Louisville Mumcipal Code is hereby amended to <br />read as follows (words to be added are underlined, words to be deleted are stasken4hfougli) <br />Sec. 9.72.050. - Signs to be posted on premises where alcohol beverages are sold. <br />It shall be the duty of the person who is the propnetor or keeper of a place <br />of business which sells, serves, or disposes of alcohol beverages to post <br />conspicuously in his place of business a sign warning underage persons that it is <br />illegal to attempt to purchase alcohol beverages in the_form and size required by <br />State law the following sign "PERSONS UNDER THE AGE OF 21 YEARS <br />NOT SERVED HERE " Failure to so post such sign shall constitute an unlawful <br />act. <br />Section 2. Section 9 72 060 of the Louisville Municipal Code entitled "Signs to be <br />posted in alcohol beverage establishments" is hereby repealed in its entirety <br />Section 3. If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance The City <br />Council hereby declares that it would have passed this ordinance and each part hereof <br />irrespective of the fact that any one part be declared invalid <br />Section 4. The repeal or modification of any provision of the Mumcipal Code of the <br />City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change m whole <br />or in part any penalty, forfeiture, or liability, either civil or cnmmal, which shall have been mcurred <br />under such provision, and each provision shall be treated and held as still remaining m force for the <br />Ordinance No 1749, Series 2017 <br />Page 1 of 2 <br />
