ORDINANCE NO. 1749 SERIES 2017 AN ORDINANCE AMENDING CHAPTER 9.72 OF THE LOUISVILLE MUNICIPAL CODE CONCERNING SIGNAGE IN LIQUOR LICENSED ESTABLISHMENTS WHEREAS, the City previously adopted Section 9 72 060 of the Louisville Municipal Code requirmg liquor licensed estabhshments to post signs prohibiting underage persons unless accompamed by their parents, and WHEREAS, the number and types of businesses obtammg liquor licenses has expanded m recent years to include, among other things, movie theaters, entertamment facilities, sportmg venues and art gallenes, and City Council finds that the signage requirement m Section 9 72 060 is no longer necessary or appropnate, and WHEREAS, the City Council also desires to amend the signage requirements m Section 9 72 050 of the Louisville Municipal Code NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. Section 9 72 050 of the Louisville Mumcipal Code is hereby amended to read as follows (words to be added are underlined, words to be deleted are stasken4hfougli) Sec. 9.72.050. - Signs to be posted on premises where alcohol beverages are sold. It shall be the duty of the person who is the propnetor or keeper of a place of business which sells, serves, or disposes of alcohol beverages to post conspicuously in his place of business a sign warning underage persons that it is illegal to attempt to purchase alcohol beverages in the_form and size required by State law the following sign "PERSONS UNDER THE AGE OF 21 YEARS NOT SERVED HERE " Failure to so post such sign shall constitute an unlawful act. Section 2. Section 9 72 060 of the Louisville Municipal Code entitled "Signs to be posted in alcohol beverage establishments" is hereby repealed in its entirety Section 3. If any portion of this ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance The City Council hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact that any one part be declared invalid Section 4. The repeal or modification of any provision of the Mumcipal Code of the City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change m whole or in part any penalty, forfeiture, or liability, either civil or cnmmal, which shall have been mcurred under such provision, and each provision shall be treated and held as still remaining m force for the Ordinance No 1749, Series 2017 Page 1 of 2
