RESOLUTION NO. 19 <br />SERIES 2018 <br />A RESOLUTION ACCEPTING THE CONVEYANCE OF AND DEEDS FOR TRANSFER <br />TO THE CITY OF TRACT B, HUTCHINSON CORNER SUBDIVISION <br />WHEREAS, the City Council by Resolution No. 68, Senes 2014 approved the Final <br />Subdivision Plat ("Plat") for the Hutchinson Corner Subdivision ("Subdivision"); and <br />WHEREAS, such Plat provided for the platting of Tract B, Hutchinson Corner <br />Subdivision ("Tract B"); and <br />WHEREAS, pursuant to the Subdivision Agreement for the Subdivision, Tract B is to be <br />conveyed to the City in partial satisfaction of the public use dedication requirements for the <br />Subdivision as required under Section 16 16.060 B of the Louisville Mumcipal Code, and <br />WHEREAS, the Subdivision Agreement further provides that the conveyance of Tract B <br />to the City is to occur after Hutchinson Corner LLC ("Subdivider") has completed certain mine <br />shaft mitigation measures and submitted to the City an updated geotechnical report mdicatmg <br />that the mine shaft mitigation measures completed by Subdivider are suitable and acceptable, <br />and <br />WHEREAS, the Subdivider has submitted such report and the Subdivision Agreement <br />provides for the City's acceptance of the conveyance of Tract B to be by City Council resolution, <br />and <br />WHEREAS, the Subdivider and Hutchinson Corner HOA ("HOA") have tendered to the <br />City special warranty deeds conveymg their mterests in Tract B to the City, and <br />WHEREAS, the City Council by this resolution desires to accept the conveyance of and <br />deeds for transfer of Tract B to the City and take other actions in connection therewith <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1 Ownership of Tract B, Hutchinson Corner Subdivision, is hereby approved and <br />accepted by the City of Louisville <br />2 Those certam special warranty deeds dated February 27, 2017 and March 8, 2017, <br />from, respectively, Hutchinson Corner HOA and Hutchinson Corner LLC, for conveyance of Tract <br />B to the City, are hereby accepted by the City <br />3 The Mayor, City Manager, City Attorney and City Staff are hereby further <br />authonzed to execute all documents and to do all things necessary on behalf of the City to effect the <br />City's ownership of the Property, including without limitation, that each of the Mayor and City <br />Manager are authorized on the City's behalf to accept and direct the recording of any such <br />Resolution No 19, Series 2018 <br />Page 1 of 2 <br />
