ORDINANCE NO. 1762 SERIES 2018 AN ORDINANCE APPROVING THE VACATION OF A 30-FOOT WIDE DRAINAGE AND UTILITY EASEMENT LOCATED ON LOTS 1 AND 2, COLORADO TECHNOLOGICAL CENTER FILING NO. 2 REPLAT A, DEDICATED BY THE PLAT OF COLORADO TECHNOLOGICAL CENTER FILING NO. 2 WHEREAS, by the plat of Colorado Technological Center Filing No. 2, recorded in the Office of the Boulder County Clerk and Recorder on November 13, 2003 at Reception No. 2527192, there was dedicated to the City a 30 foot drainage and utility easement on Lots 8, 9, 10, 13 and 14 of such Subdivision in the location further described in Exhibit A attached hereto and incorporated herein by this reference ("the 30 foot easement"); and WHEREAS, the 30 foot easement is also set forth on the plat of Colorado Technological Center Filing No. 2 Replat A, recorded in the Office of the Boulder County Clerk and Recorder on October 25, 2012 at Reception No. 03262248: and WHEREAS, a Final Planned Unit Development and Subdivision Plat application have been approved by the City for re -subdivision of property encumbered by the 30 foot easement under the name Colorado Technological Center Filing No. 2 Replat C; and WHEREAS, the 30 foot easement currently contains a storm sewer line that will be relocated by the developer of Lots 1 and 2, Colorado Technological Center Filing No. 2 Replat C within new easements dedicated to the City by the Colorado Technological Center Filing No. 2 Replat C Final Plat, recorded in the Office of Boulder County Clerk and Recorder on , 2018 at Reception No. S ; and WHEREAS, the City Council finds and determines that following relocation of the existing storm sewer line, the 30 foot drainage and utility easement for which vacation is requested is not and will not be needed for any public, governmental or utility purposes; and WHEREAS, the City Council desires to approve the application and vacate the City's interests in the 30 foot easement for which vacation is requested; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The City hereby approves the vacation of that certain 30-foot wide drainage and utility easement located on Lots 1 and 2 Colorado Technological Center Filing No. 2 Replat A which easement herein vacated is in the location further described in Exhibit A attached hereto and incorporated herein by this reference ("the 30 foot easement"). Section 2. All other ordinances or portions thereof inconsistent or in conflict with this ordinance or any portion hereof are repealed to the extent of such inconsistency or conflict.
