ORDINANCE NO 1767 <br />SERIES 2018 <br />AN ORDINANCE AMENDING CERTAIN PROVISIONS OF CHAPTER 3.18 OF THE <br />LOUISVILLE MUNICIPAL CODE AND ADOPTING AN UPDATED SCHEDULE OF <br />DEVELOPMENT IMPACT FEES <br />WHEREAS, in 2016, as part of its five-year review under Section 3 18 100 of the <br />Louisville Municipal Code (the "Code"), and in order to continue to implement an equitable <br />impact fee system, the City appointed an Impact Fee Liaison Committee to review the City's <br />Impact Fees, and as part of such review there was commissioned and has been prepared an <br />impact fee study entitled City of Louisville, Colorado Development Impact Fee Study dated April <br />18, 2017 ("Impact Fee Study"); and <br />WHEREAS, the Impact Fee Study found that new development in the City was placing <br />and was projected to place an increased demand upon the City's Transportation Capital <br />Facilities, Library Capital Facilities, and Parks and Trails Capital Facilities; and <br />WHEREAS, consistent with the recommendations in the Impact Fee Study, the City by <br />Ordmance No. 1737, Series 2017, adopted an updated schedule of development Impact Fees and <br />discontinued collection of Impact Fees for Municipal Capital Facilities and Recreation Capital <br />Facilities; however, some references to such facilities remain in the Code; and <br />WHEREAS, the City Council desires to amend the Code to remove all remaining <br />references to Municipal Capital Facilities and Recreation Capital Facilities, and <br />WHEREAS, the debt associated with the construction of City Library Capital Facilities <br />has been paid off, and thus the City by this Ordmance mtends to adjust the Impact Fees for <br />Library Capital Facilities to discontinue the component of the fee that covers debt service on the <br />library construction and continue to collect the fee for library materials, effective on and after the <br />effective date of this Ordinance. <br />NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO <br />Section 1 Subsection (C) of Section 3 18 030, Definitions, of the Louisville <br />Municipal Code is hereby amended to read as follows (words added are underlined, words <br />deleted are stfielorn-thfeugh) <br />C. Capital facilities. Any improvement or facility that: <br />to provide; <br />1 Is directly related to any service that the city is authorized <br />2.
