ORDINANCE NO 1777 <br />SERIES 2019 <br />AN ORDINANCE AMENDING TITLES 5 AND 17 CONCERNING RETAIL <br />MARIJUANA CULTIVATION FACILITIES AND SUBMITTING TO THE <br />REGISTERED ELECTORS OF THE CITY OF LOUISVILLE AT THE REGULAR <br />MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 5, 2019, THE <br />QUESTION OF WHETHER TO PERMIT SUCH RETAIL MARIJUANA <br />CULTIVATION FACILITIES WITHIN THE CITY SUBJECT TO AN EXCISE TAX <br />ON THE SAME <br />WHEREAS, the City Council previously adopted licensing standards and <br />regulations governing the time, place, manner, and number of retail marijuana <br />businesses, which such standards and regulations are set forth in Chapter 5 11 <br />and Title 17 of the Louisville Municipal Code, which standards and regulations do <br />not permit retail marijuana cultivation facilities to be located within the City; and <br />WHEREAS, by Ordinance No 1776, Series 2019, the City Council <br />submitted to the registered electors of the City at the November 5, 2019 regular <br />election a ballot issue concerning an excise tax of up to ten percent (10%) on the <br />first sale or transfer of unprocessed marijuana by a retail marijuana cultivation <br />facility (the "Cultivation Excise Tax"), provided that such Cultivation Excise Tax <br />shall be imposed only if retail marijuana cultivation facilities are permitted within <br />the City; and <br />WHEREAS, the City Council is of the opinion that it should refer to the <br />voters at the November 5, 2019 regular municipal election the question of whether <br />retail marijuana cultivation facilities should be permitted on property located within <br />the City's Industrial ("I") zone district or as an industrial use within the City's <br />Planned Community Zone District ("PCZD"), subject to the regulations set forth <br />herein, and <br />WHEREAS, if a majority of the City's registered electors vote at the <br />November 5, 2019 election in favor of the question referred herein, this ordinance <br />will take effect on January 1, 2020 <br />THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO <br />Section 1. A regular municipal election will be held in the City of <br />Louisville, County of Boulder, State of Colorado, on Tuesday, November 5, 2019, <br />between the hours of 7 00 a m and 7 00 p m (the "Election") <br />Ordinance No 1777, Series 2019 <br />Page 1 of 8 <br />
