ORDINANCE NO. 1542 <br /> SERIES 2008 <br /> AN ORDINANCE AMENDING CERTAIN SECTIONS OF CHAPTER 2.76 OF THE <br /> LOUISVILLE MUNICIPAL CODE RELATING TO THE REGULATION OF <br /> CEMETERIES AND THE DISTRIBUTION OF FUNDS RECEIVED FROM THE SALE <br /> OF GRAVE SPACES; ESTABLISHING THE CEMETERY FUND AS A SPECIAL <br /> REVENUE FUND OF THE CITY; AND TRANSFERRING A PORTION OF THE FUND <br /> BALANCE OF THE CEMETERY PERPETUAL CARE FUND TO THE CEMETERY <br /> FUND FOR FUNDING OF LOUISVILLE CEMETERY MASTER PLAN <br /> IMPROVEMENTS <br /> WHEREAS, the City is authorized by law to establish a municipal cemetery and <br /> pursuant to such authority owns,operates and maintains the Louisville Cemetery; and <br /> WHEREAS, the City intends to undertake an expansion of the Louisville Cemetery <br /> pursuant to the Louisville Cemetery Master Plan, which expansion will be funded in part from <br /> funds from the Cemetery Perpetual Care Fund; and <br /> WHEREAS, the City Council desires to establish the Cemetery Fund as a special <br /> revenue fund to account for funds used for care, operation, maintenance, improvement and <br /> expansion of the Louisville Cemetery and other cemetery purposes and expenses, to be a fund <br /> apart from the Cemetery Perpetual Care Fund; and <br /> WHEREAS, the City Council fund desires to transfer to the Cemetery Fund a portion of <br /> the fund balance of the Cemetery Perpetual Care Fund to be used for funding Louisville <br /> Cemetery Master Plan improvements beginning in 2009; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br /> CITY OF LOUISVILLE, COLORADO: <br /> Section 1. Section 2.76.060 of the Louisville Municipal Code is hereby amended to <br /> read as follows (words to be added are underlined; words to be deleted are stricken through): <br /> Sec. 2.76.060. Price of spaces. <br /> The sale price of grave spaces, including perpetual care, shall be <br /> established by the director of parks and recreation . . • . _ . <br /> Fifty percent of the proceeds from the sale of lots shall be placed in the City's <br /> "cemetery perpetual care fund," and fifty percent shall be placed in the City's <br /> "cemetery fund."to be emit on cemetery expenses. <br /> Section 2.
