RESOLUTION NO. ~6 <br />SERIES 2009 <br />A RESOLUTION APPROVING A LEASE AMENDMENT AND LEASE EXTENSION <br />CONCERNING THE CITY'S LEASE TO THE UNITED STATES POSTAL SERVICE <br />OF LOTS 1, 2, 3 AND 4, BLOCK 4, TOWN OF LOUISVILLE <br />WHEREAS, by deed dated October 15, 2008, the City of Louisville, a Colorado home <br />rule municipal corporation (the "City"), is the owner of Lots 1, 2, 3 and 4, Block 4, Town of <br />Louisville, County of Boulder, State of Colorado, such property having an address of 637 Front <br />Street; and <br />WHEREAS, the property is subject to a lease with the United States Postal Service (the <br />"USPS") for its Downtown Station (USPS facility 075670-002), which lease was assigned to the <br />City at its closing on the purchase of the property; and <br />WHEREAS, the current LISPS lease expires January 31, 2009 and the LISPS has <br />requested atwo-month extension of the lease, until March 31, 2009; and <br />WHEREAS, a lease amendment and lease extension has been proposed for such <br />purpose; and <br />WHEREAS, the City is authorized to enter into such a lease amendment and lease <br />extension pursuant to its home rule charter and other applicable law, and desires by this <br />resolution to approve same and authorize its execution; <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />Section 1. The proposed Lease Amendment and Lease Extension between the City of <br />Louisville and the United States Postal Service for an extension of the lease of Lot 1, 2, 3 and 4, <br />Block 4, Town of Louisville, is hereby approved in essentially the same form as the copy of such <br />Lease Amendment and Lease Extension accompanying this Resolution. <br />Section 2. Mayor Pro Tem Sheri Marsella and Town Clerk Nancy Varra are hereby <br />authorized to execute the Lease Amendment and Lease Extension on behalf of the City, and the <br />Mayor, Mayor Pro Tem and City Manager are further hereb;~ granted the authority to negotiate and <br />approve such revisions to said form of Lease Amendment and Lease Extension as are determined <br />necessary or desirable for the protection of the City, so long as the essential terms and conditions of <br />thereof are not altered. <br />Section 3. The City Manager and City Staff are further authorized to do all things <br />necessary on behalf of the City to perform the obligations of 'the City under the lease, as amended by <br />the Lease Amendment and Lease Extension and to execute and deliver any and all documents <br />necessary to effect the terms and conditions thereof. <br />1 <br />
