RESOLUTION NO. 23 <br />SERIES 2021 <br />A RESOLUTION APPROVING A PRELIMINARY AND FINAL PLANNED UNIT <br />DEVELOPMENT TO ALLOW CONSTRUCTION OF A 100,000 SF INDUSTRIAL <br />BUILDING, A PRELIMINARY AND FINAL PLANNED UNIT DEVELOPMENT AND <br />SPECIAL REVIEW USE TO ALLOW A 3,500 SF CONVENIENCE STORE AND AUTO <br />FUELING STATION, AND ASSOCIATED SITE IMPROVEMENTS, AND A FINAL <br />PLAT TO CREATE 2 PARCELS, 4 LOTS, AND 2 OUTLOTS LOCATED AT THE <br />NORTHEAST CORNER OF S. 96TH STREET AND DILLON ROAD; A PORTION OF <br />THE SW QUARTER OF SECTION 16, TOWNSHIP 1 SOUTH, RANGE 69 WEST OF <br />THE 6T" P.M. <br />WHEREAS, United Properties has submitted an application for a preliminary and <br />final Planned Unit Development to allow construction of a 100,000 sf industrial building, <br />a preliminary and final planned unit development and special review use to allow a 3,500 <br />sf convenience store and auto fueling station, and associated site improvements, and a <br />final plat to create 2 parcels, 4 lots, and 2 outlots; and <br />WHEREAS, after a duly noticed public hearing on February 11, 2021, where <br />evidence and testimony were entered into the record, including the findings in the <br />Louisville Planning Commission staff report dated February 11, 2021, the Planning <br />Commission recommended approval the Special Review Use and Planned Unit <br />Development with two conditions; and <br />WHEREAS, City staff has reviewed the information submitted and found that the <br />application complies with the Louisville zoning regulations and other applicable sections <br />of the Louisville Municipal Code; and <br />WHEREAS, the City Council has considered the application at a duly noticed <br />public hearing on March 16, 2021, where evidence and testimony were entered into the <br />record, including the findings in the Louisville City Council staff report dated March 16, <br />2021. <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Louisville, Colorado does hereby approve a preliminary and final Planned Unit <br />Development to allow construction of a 100,000 sf industrial building, a preliminary and <br />final planned unit development and special review use to allow a 3,500 sf convenience <br />store and auto fueling station, and associated site improvements, and a final plat to <br />create 2 parcels, 4 lots, and 2 outlots, with the following condition: <br />1. The fueling station on Lot 2 shall include at least one (1) DC Fast, Level 3 <br />Electric Vehicle Charging Station. Such Charging Station shall be installed <br />prior to Certificate of Occupancy. If equal or better charging technology <br />becomes available in the future, the Charging Station may be converted to <br />the new technology. <br />Resolution No. 23, Series 2021 <br />Page 1 of 2 <br />
