Denied on Second Reading <br />ORDINANCE NO. 1806 <br />SERIES 2021 <br />AN ORDINANCE APPROVING THE VACATION OF A 53.56-FOOT LONG PORTION <br />OF A 5-FOOT WIDE UTILITY EASEMENT ON LOTS 22, 23, AND 24, EXCEPT THE <br />EAST THREE AND A HALF FEET OF LOT 22, BLOCK 6, JEFFERSON PLACE <br />WHEREAS, by the plat of Jefferson Place, recorded in the Office of the Boulder County <br />Clerk and Recorder on September 23, 1880 at Reception No. 2374, there was dedicated to the City a <br />10-foot alley right-of-way, later vacated by Ordinance No. 1845, Series 2006; and <br />WHEREAS, the vacation of the alley by Ordinance No. 1845, Series 2006 reserved a 5- <br />foot wide utility easement along the northern boundary of 701 Pine Street (Lots 22, 23, and 24, <br />except the east three and a half feet of Lot 22, Block 6, Jefferson Place); and <br />WHEREAS, a residential building permit has been submitted in 2020 for a new single <br />family residence at 701 Pine Street with detached garage that encroaches into the 5-foot wide <br />utility easement; and <br />WHEREAS, the City Council finds and determines that the 53.56-foot long portion of the 5- <br />foot wide utility easement for which vacation is requested is not and will not be needed for any public, <br />governmental or utility purposes; and <br />WHEREAS, the City Council desires to approve the application and vacate the portion of the <br />5-foot utility easement for which vacation is requested; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The City hereby approves the vacation of that certain 53.56 long portion of <br />the 5-foot wide utility easement located on Lots 22, 23, and 24, except the east three and a half feet <br />of Lot 22, Block 6, Jefferson Place, which easement herein vacated is in the location further described <br />in Exhibit A attached hereto and incorporated herein by this reference ("the 5-foot easement"). <br />Section 2. All other ordinances or portions thereof inconsistent or in conflict with this <br />ordinance or any portion hereof are repealed to the extent of such inconsistency or conflict. <br />Section 3. The Mayor and City Manager, or either of them, is authorized to execute such <br />additional documents as may be necessary to evidence the partial vacation of the 5-foot easement <br />herein vacated, including but not execution of quit claim deeds. <br />Ordinance No. 1806, Series 2021 <br />Page 1 of 4 <br />
