ORDINANCE NO. 1283 SERIES 1998 AN ORDINANCE AUTHORIZING AND RELATING TO THE PAYMENT OF CITY MONEYS FOR THE ACQUISITION OF VACANT REAL ESTATE, WATER RIGHTS AND A CONSERVATION EASEMENT, FOR OPEN SPACE, CONSERVATION, AND RIGHT- OF-WAY PURPOSES WHEREAS, the City of Louisville and the County of Boulder intend to enter into a Purchase Contract to Buy and Sell Vacant Real Estate, Water Rights and Conservation Easement with Warembourg Colorado Ranches, LLC, and Klubert Warembourg and Helen Rose Warembourg (the "Purchase Contract"); and WHEREAS, the Purchase Contract is for City and County acquisition, for open space, conservation, and right-of-way purposes, of title to and a conservation easement in certain parcels of real estate totaling approximately 296 acres and located on the west side of 96th Street and the north side of Dillon Road, together with certain water rights (the "Property"); and WHEREAS, the Property is more particularly described in Exhibit A and depicted in Exhibit B; and WHEREAS, the City and County shall pay the owners of the Property a total purchase price of six million two hundred and twenty-one thousand dollars ($6,221,000.00), for the Property, with the City to pay three million two hundred and sixty- eight thousand eight hundred and thirteen dollars ($3,268,813.00) of the total purchase price; and WHEREAS, the City Council by this ordinance desires to authorize such purchase, identify the sources of funding for such purchase, and otherwise comply with Section 31- 25-202, Colorado Revised Statutes. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The City Council hereby authorizes the acquisition, for open space, conservation, and right-of-way purposes, of title to and a conservation easement in certain parcels of real estate totaling approximately 296 acres and located on the west side of 96th Street and the north side of Dillon Road, together with certain water rights, such property being described in Exhibit A and depicted in Exhibit B attached hereto; and Section 2. Unless other funds become available for use by the City as determined by the City Council, moneys from the following funds may be used to pay during 1998 the City's three million two hundred and sixty-eight thousand eight hundred and thirteen dollar ($3,268,813.00) share of the purchase price of the Property which is described in Exhibit
