ORDINANCE NO. 1283 <br />SERIES 1998 <br /> <br />AN ORDINANCE AUTHORIZING AND RELATING TO THE PAYMENT OF CITY <br />MONEYS FOR THE ACQUISITION OF VACANT REAL ESTATE, WATER RIGHTS AND <br />A CONSERVATION EASEMENT, FOR OPEN SPACE, CONSERVATION, AND RIGHT- <br />OF-WAY PURPOSES <br /> <br /> WHEREAS, the City of Louisville and the County of Boulder intend to enter into a <br />Purchase Contract to Buy and Sell Vacant Real Estate, Water Rights and Conservation <br />Easement with Warembourg Colorado Ranches, LLC, and Klubert Warembourg and Helen <br />Rose Warembourg (the "Purchase Contract"); and <br /> <br /> WHEREAS, the Purchase Contract is for City and County acquisition, for open <br />space, conservation, and right-of-way purposes, of title to and a conservation easement <br />in certain parcels of real estate totaling approximately 296 acres and located on the west <br />side of 96th Street and the north side of Dillon Road, together with certain water rights (the <br />"Property"); and <br /> <br /> WHEREAS, the Property is more particularly described in Exhibit A and depicted <br />in Exhibit B; and <br /> <br /> WHEREAS, the City and County shall pay the owners of the Property a total <br />purchase price of six million two hundred and twenty-one thousand dollars <br />($6,221,000.00), for the Property, with the City to pay three million two hundred and sixty- <br />eight thousand eight hundred and thirteen dollars ($3,268,813.00) of the total purchase <br />price; and <br /> <br /> WHEREAS, the City Council by this ordinance desires to authorize such purchase, <br />identify the sources of funding for such purchase, and otherwise comply with Section 31- <br />25-202, Colorado Revised Statutes. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. The City Council hereby authorizes the acquisition, for open space, <br />conservation, and right-of-way purposes, of title to and a conservation easement in certain <br />parcels of real estate totaling approximately 296 acres and located on the west side of 96th <br />Street and the north side of Dillon Road, together with certain water rights, such property <br />being described in Exhibit A and depicted in Exhibit B attached hereto; and <br /> <br /> Section 2. Unless other funds become available for use by the City as determined <br />by the City Council, moneys from the following funds may be used to pay during 1998 the <br />City's three million two hundred and sixty-eight thousand eight hundred and thirteen dollar <br />($3,268,813.00) share of the purchase price of the Property which is described in Exhibit <br /> <br /> <br />
