RESOLUTION NO.4 <br />SERIES 2022 <br />A RESOLUTION WAIVING BUILDING PERMIT FEES FOR DEMOLITION OF <br />STRUCTURES DAMAGED OR DESTROYED BY THE MARSHALL FIRE <br />WHEREAS, on December 30, 2021, the Marshall Fire ignited in Boulder County and <br />quickly spread to the City of Louisville, resulting in severe damage or total loss of almost six <br />hundred (600) structures within the City of Louisville, most of them residential homes; and <br />WHEREAS, also on December 30, 2021, the Mayor of the City of Louisville, pursuant to <br />Chapter 2.32 of the Louisville Municipal Code and C.R.S. § 24-33.5-709, executed a Declaration <br />of Local Disaster Emergency in and for the City of Louisville, which Disaster Declaration was <br />thereafter continued in effect by resolution of the City Council, and the Governor of the State of <br />Colorado issued a Declaration of Statewide Emergency in response to the Marshall Fire; and <br />WHEREAS, on January 1, 2022, President Joseph R. Biden approved a Major Disaster <br />Declaration for the Event (DR-4634-CO) beginning on December 30, 2021 and continuing <br />thereafter; and <br />WHEREAS, the destruction left by the Marshall Fire includes unprecedented amounts of <br />debris that will need to be removed before rebuilding and other restoration efforts may commence; <br />and <br />WHEREAS, the soot and ash from structure fires may be toxic and contain carcinogens, <br />making it imperative that such debris be disposed of in a timely and proper manner to mitigate <br />risks to public health and safety; and <br />WHEREAS, under the authority conferred by the Disaster Declaration and Section <br />2.32.020.0 of the Louisville Municipal Code, the City Manager entered into an Intergovernmental <br />Agreement for the Provision of Assistance for Debris Removal resulting from the Colorado <br />Wildfires and Straight -Line Winds Disaster (DR-4653-C) with Boulder County (the "Debris <br />Removal IGA"; and <br />WHEREAS, pursuant to the Debris Removal IGA, Boulder County will conduct debris <br />removal on properties damaged or destroyed by the Marshall Fire unless property owners decline <br />("opt -out"); and <br />WHEREAS, a City demolition permit is not required in connection with Boulder County's <br />work under the Debris Removal IGA because all such work will be conducted and supervised by <br />Boulder County, and will require no oversight by the City; and <br />WHEREAS, property owners who opt -out of debris removal by Boulder County must <br />obtain a City permit before demolition may be undertaken; and <br />Resolution No. 4, Series 2022 <br />Page 1 of 2 <br />
