ORDINANCE NO. 1372 <br />SERIES 2001 <br /> <br />AN EMERGENCY ORDINANCE AUTHORIZING THE PAYMENT OF CITY MONEYS <br />FOR THE ACQUISITION OF VACANT REAL ESTATE FOR OPEN SPACE PURPOSES <br /> <br /> WHEREAS, the City of Louisville, City of Lafayette and County of Boulder intend to enter <br />into a Purchase Agreement with Fingru AG, Inc., and an Agreement to Exchange Reciprocal <br />Conservation Easements, for the acquisition, for open space purposes, of approximately 55.34 acres <br />of property owned by Fingru AG, Inc. (the "Property"); and <br /> <br /> WHEREAS, the Property lies within the City of Lafayette between Empire Road and Coal <br />Creek and northwest of the intersection of Empire Road and South 104th Street, and is more <br />particularly described in Exhibit A; and <br /> <br /> WHEREAS, Louisville, Lafayette and Boulder County shall pay the owner of the Property <br />a total purchase price of two million three hundred thousand dollars ($2,300,000.00), for the <br />Property, with the City to pay five hundred and seventy five hundred dollars ($575,000.00) of the <br />total purchase price; and <br /> <br /> WHEREAS, the City Council by this ordinance desires to identify the sources of funding <br />for such purchase and otherwise comply with Section 31-25-202, Colorado Revised Statutes. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> ~ection 1. Unless other funds become available for use by the City as determined by <br />the City Council, moneys from the City Conservation Trust Fund - Land Acquisition shall be used <br />to pay the City's share of the purchase price of the Property, which Property is described on Exhibit <br />A and in the Purchase Agreement therefor. <br /> <br /> ~. City payment for the Property shall be made in cash, certified funds or City <br />warrant, subject to the Purchase Agreement and to any necessary budgetary transfers or <br />supplementary budgets and appropriations in accordance with State law. <br /> <br /> ~. Nothing in this Ordinance is intended to nor should be construed to create <br />any multiple-fiscal year direct or indirect City debt or fiscal obligation whatsoever. <br /> <br /> ~ection 4. If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact <br />that any one part be declared invalid. <br /> <br /> <br />
