11/21/2001 11 Boulder County Clerk, CO ORD R 85,00 D 0.00 oRDINANCE NO. 1370 SERIES 2001 AN ORDINANCE DISCONNECTING FROM THE CITY OF LOUISVILLE, COLORADO, CERTAIN PARCELS OF LAND LYING WITHIN THE GLACIER PARK, BOULDER COUNTY LAND VENTURE AND TRILLIUM OPEN SPACE PROPERTIES WHEREAS, by Ordinance No. 1360, Series 2001, certain parcels of land referred to as the Glacier Park, Boulder County Land Venture, and Trillium open space properties were disconnected from the corporate boundaries of the City of Louisville; and WHEREAS, there was excepted from such disconnection the original alignment of the Northwest Parkway, the new alignment of the Northwest Parkway, a certain parcel of land lying between such alignments, and certain portions of the Dillon Road and South 104th Street rights-of- way (collectively the "Right-of-Way Parcels"); and WHEREAS, on September 13, 2001, the Board of County Commissioners of the County of Boulder submitted to the City a petition for the enactment of an ordinance pursuant to C.R.S. §31- 12-501 disconnecting the Right-of-Way Parcels from the corporate boundaries of the City of Louisville; and WHEREAS, the Right-of-Way Parcels subject to the petition for disconnection are legally described in Exhibit A attached hereto; and WHEREAS, the new alignment of the Northwest Parkway has been conveyed from Boulder County to the Northwest Parkway Public Highway Authority (the "PHA"), and the PHA has consented to and joined in the petition requesting disconnection of the new alignment of the Northwest Parkway; and WHEREAS, the remaining portions of the Right-of-Way Parcels to be disconnected are either owned by the City and County an tenants in common, or by the City with respect to portions of the Dillon Road and South 104th Street rights-of-way; and WHEREAS, pursuant to C.R.S. §31-12-501, the City Council has given due consideration to the petition; and WHEREAS, the City Council finds and determines that the best interests of the City and its citizens will not be prejudiced by the disconnection of the Right-of-Way Parcels, and that the disconnection of such parcels should be effected by ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO:
