11/21/2001 11 <br />Boulder County Clerk, CO ORD R 85,00 D 0.00 <br /> <br />oRDINANCE NO. 1370 <br />SERIES 2001 <br /> <br />AN ORDINANCE DISCONNECTING FROM THE CITY OF LOUISVILLE, <br />COLORADO, CERTAIN PARCELS OF LAND LYING WITHIN THE <br />GLACIER PARK, BOULDER COUNTY LAND VENTURE AND <br />TRILLIUM OPEN SPACE PROPERTIES <br /> <br /> WHEREAS, by Ordinance No. 1360, Series 2001, certain parcels of land referred to as the <br />Glacier Park, Boulder County Land Venture, and Trillium open space properties were disconnected <br />from the corporate boundaries of the City of Louisville; and <br /> <br /> WHEREAS, there was excepted from such disconnection the original alignment of the <br />Northwest Parkway, the new alignment of the Northwest Parkway, a certain parcel of land lying <br />between such alignments, and certain portions of the Dillon Road and South 104th Street rights-of- <br />way (collectively the "Right-of-Way Parcels"); and <br /> <br /> WHEREAS, on September 13, 2001, the Board of County Commissioners of the County of <br />Boulder submitted to the City a petition for the enactment of an ordinance pursuant to C.R.S. §31- <br />12-501 disconnecting the Right-of-Way Parcels from the corporate boundaries of the City of <br />Louisville; and <br /> <br /> WHEREAS, the Right-of-Way Parcels subject to the petition for disconnection are legally <br />described in Exhibit A attached hereto; and <br /> <br /> WHEREAS, the new alignment of the Northwest Parkway has been conveyed from <br />Boulder County to the Northwest Parkway Public Highway Authority (the "PHA"), and the PHA <br />has consented to and joined in the petition requesting disconnection of the new alignment of the <br />Northwest Parkway; and <br /> <br /> WHEREAS, the remaining portions of the Right-of-Way Parcels to be disconnected are <br />either owned by the City and County an tenants in common, or by the City with respect to portions <br />of the Dillon Road and South 104th Street rights-of-way; and <br /> <br /> WHEREAS, pursuant to C.R.S. §31-12-501, the City Council has given due consideration <br />to the petition; and <br /> <br /> WHEREAS, the City Council finds and determines that the best interests of the City and its <br />citizens will not be prejudiced by the disconnection of the Right-of-Way Parcels, and that the <br />disconnection of such parcels should be effected by ordinance. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> <br />
