ORDINANCE NO. 1358 <br />SERIES 2001 <br /> <br />AN ORDINANCE AUTHORIZING THE PAYMENT OF CITY MONEYS <br /> FOR THE ACQUISITION OF VACANT REAL ESTATE <br /> <br /> WHEREAS, the City of Louisville and The Archdiocese of Denver have entered into a <br />Purchase and Sale Contract for the City's acquisition, for potential use for public buildings and <br />facilities and other governmental purposes, of a parcel of land of 15.198 acres, more or less, located <br />at the southeast comer of the intersection of McCaslin Boulevard and Via Appia and legally <br />described as Lot 1, Block 1, Saint Louis Parish Subdivision, City of Louisville, County of Boulder, <br />State of Colorado (hereinafter "the Property"); and <br /> <br /> WHEREAS, the Purchase and Sale Contract provides that the City shall pay the owner of <br />the Property a total purchase price of Two Million Dollars ($2,000,000.00) for the Property; and <br /> <br /> WHEREAS, the City Council by this ordinance desires to identify the source of funding for <br />such purchase and otherwise comply with the Colorado Revised Statutes regarding the acquisition <br />of the Property. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1, Unless other funds become available for use by the City as determined by <br />the City Council, moneys from the City Capital Projects Fund shall be used to pay the purchase <br />price of the Property, which Property is described as Lot 1, Block 1, Saint Louis Parish Subdivision, <br />City of Louisville, County of Boulder, State of Colorado. <br /> <br /> ~. City payment for the Property shall be made in cash, certified funds or City <br />warrant, subject to the Purchase and Sale Contract and to any necessary budgetary transfers or <br />supplementary budgets and appropriations in accordance with State law. <br /> <br /> ~. Nothing in this Ordinance is intended to nor should be construed to create <br />any multiple-fiscal year direct or indirect City debt or fiscal obligation whatsoever. <br /> <br /> ~qection & If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact <br />that any one part be declared invalid. <br /> <br /> Section ~. All other ordinances or portions thereof inconsistent or conflicting with this <br />ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict. <br /> <br /> <br />
