ORDINANCE NO. 1358 SERIES 2001 AN ORDINANCE AUTHORIZING THE PAYMENT OF CITY MONEYS FOR THE ACQUISITION OF VACANT REAL ESTATE WHEREAS, the City of Louisville and The Archdiocese of Denver have entered into a Purchase and Sale Contract for the City's acquisition, for potential use for public buildings and facilities and other governmental purposes, of a parcel of land of 15.198 acres, more or less, located at the southeast comer of the intersection of McCaslin Boulevard and Via Appia and legally described as Lot 1, Block 1, Saint Louis Parish Subdivision, City of Louisville, County of Boulder, State of Colorado (hereinafter "the Property"); and WHEREAS, the Purchase and Sale Contract provides that the City shall pay the owner of the Property a total purchase price of Two Million Dollars ($2,000,000.00) for the Property; and WHEREAS, the City Council by this ordinance desires to identify the source of funding for such purchase and otherwise comply with the Colorado Revised Statutes regarding the acquisition of the Property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1, Unless other funds become available for use by the City as determined by the City Council, moneys from the City Capital Projects Fund shall be used to pay the purchase price of the Property, which Property is described as Lot 1, Block 1, Saint Louis Parish Subdivision, City of Louisville, County of Boulder, State of Colorado. ~. City payment for the Property shall be made in cash, certified funds or City warrant, subject to the Purchase and Sale Contract and to any necessary budgetary transfers or supplementary budgets and appropriations in accordance with State law. ~. Nothing in this Ordinance is intended to nor should be construed to create any multiple-fiscal year direct or indirect City debt or fiscal obligation whatsoever. ~qection & If any portion of this ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact that any one part be declared invalid. Section ~. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict.
