10f26/2001 03:09P Boulder County Clerk, CO ORD R 20.00 D 0.00 ORDINANCE NO. 1356 SERIES 2001 AN ORDINANCE APPROVING THE VACATION OF A PORTION OF AN ALLEY RIGHT-OF-WAY WITHIN THE JEFFERSON PLACE SUBDIVISION IN THE CITY OF LOUISVILLE. WHEREAS, by the plat of the Jefferson Place Subdivision, recorded December 27, 1880, in Plat Book 2 at Page 9, Boulder County Records, there was dedicated to the City a right-of-way for an alley lying within Block 2 of Jefferson Place Subdivision; and WHEREAS, proper application has been made to the City for vacation of that portion of such alley right-of-way lying adjacent to and north of Lots 1 through 5, Block 2, and adjacent to and south of Lot 6, Block 2, Jefferson Place Subdivision, such portion being further described on Exhibit A, attached hereto; and WHEREAS, the City Council has determined that the alley right-of-way for which vacation has been requested is not and has not been used or required as a roadway or thoroughfare for the public; and WHEREAS, the City Council has determined that the alley right-of-way for which vacation is requested is not and will not be needed for any public purposes other than continued use for public utilities; and WHEREAS, the City Council has determined that the alley right-of-way for which vacation is requested is not being used or held for park purposes or for any other governmental purposes; and WHEREAS, the City Council desires to approve the application and vacate the City's interests in the alley right-of-way described herein for which vacation is requested. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOLn/SV!LLE, COLOg_A. DO: ~qection 1. The City hereby vacates that certain alley fight-of-way lying within Block 2 of Jefferson Place Subdivision, City of Louisville, Boulder County, Colorado, that is legally described in Exhibit A, attached hereto and incorporated herein by reference (hereinafter the "Alley Right-of-Way"). Title to the vacated Alley Right-of-Way shall vest in the manner provided by law. ~. Easements are hereby reserved in, under and over the Alley Right-of-Way for the location and use of public utilities. Further, easements for existing public utilities, if any, shall not be altered or amended by virtue of this ordinance.
