RESOLUTION NO. 5 <br />SERIES 2023 <br />A RESOLUTION AUTHORIZING FUNDING OF FOUNDATION REMOVAL AND FINAL <br />DEBRIS CLEAN UP FOLLOWING THE MARSHALL FIRE FOR 130 CHERRYWOOD <br />LANE <br />WHEREAS, on December 30, 2021, the Marshall Fire ignited and quickly spread <br />to the City of Louisville, resulting in severe damage or total loss of almost six hundred <br />(600) structures within the City of Louisville, most of them residential homes; and <br />WHEREAS, also on December 30, 2021, the Mayor of the City of Louisville, <br />pursuant to Chapter 2.32 of the Louisville Municipal Code and C.R.S. § 24-33.5-709, <br />executed a Declaration of Local Disaster Emergency in and for the City of Louisville, <br />which Declaration was thereafter continued in effect by resolution of the City Council, and <br />the Governor of the State of Colorado issued a Declaration of Statewide Emergency in <br />response to the Marshall Fire; and <br />WHEREAS, FEMA and the State of Colorado agreed to fund 90% and 5% <br />respectively a Private Property Debris Removal (PPDR) program, with the City of <br />Louisville funding the remaining 5%; and <br />WHEREAS, the property at 130 Cherrywood Lane was requested to be eligible by <br />the city and was determined to be eligible for the program by FEMA; and <br />WHEREAS, through no fault of their own, the property owners were not able to <br />authorize removal of the foundation at 130 Cherrywood Lane during the time period when <br />the PPDR program was active in the city, and now request the City Council approve <br />funding to complete the removal of the foundation; and <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1. Reimbursement by the City. Mr. Dailey will hire and direct such work as <br />required to pass a final inspection to complete the debris removal, including the remaining <br />foundation and backfilling the lot, on the property at 130 Cherrywood Lane. Once the debris <br />removal is complete, the demolition permit passes final inspection and Mr. Dailey provides <br />evidence the contractor has been paid in full, the City shall reimburse for actual costs, in an <br />amount not -to -exceed $17,500.00. <br />PASSED AND ADOPTED this <br />7th day of Feb a , 2023. <br />Dennis Maloney, Mayor <br />Resolution No. 5, Series 2023 <br />Page 1 of 1 <br />
