RESOLUTION NO. 10 <br />SERIES 2023 <br />A RESOLUTION APPROVING A SITE OPTION AND LEASE AGREEMENT FOR <br />THE ATTACHMENT OF CERTAIN WIRELESS EQUIPMENT TO THE LOUISVILLE <br />RECREATION AND SENIOR CENTER <br />WHEREAS, pursuant to Section 3.04.130(B) of the Louisville Municipal Code, any lease of <br />City property for a term beyond more than one fiscal year must be approved by the City Council by <br />ordinance or resolution, as the City Council shall determine; and <br />WHEREAS, DISH Wireless L.L.C. ("DISH") has requested the right to attach three antennas <br />to the Louisville Recreation and Senior Center roof, and occupy an area of the wall left abandoned by <br />a previous wireless carrier; and <br />WHEREAS, there has been prepared a Site Option and Lease Agreement ("Agreement") to <br />grant DISH such rights in exchange for DISH's payment of rent and other good and valuable <br />consideration, and which contains terms for the protection of the City government and the health, <br />safety, and welfare of the public; and <br />WHEREAS, the City Council by this Resolution desires to approve the Agreement. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The Site Option and Lease Agreement between the City of Louisville and <br />DISH Wireless L.L.C. ("Agreement"), a copy of which Agreement accompanies this Resolution, is <br />hereby approved. <br />Section 2. The Mayor and City Clerk are hereby authorized to execute the Agreement, <br />and the Mayor is hereby further authorized to negotiate and approve such revisions to the Agreement <br />as the Mayor determines are necessary or desirable for the protection of the City, so long- as the <br />essential terms and conditions of the Agreement are not altered. <br />PASSED AND ADOPTED this 21 st day of Febru ry, 023. <br />i&, <br />Dennis Maloney, Mayor <br />ATTEST: <br />G;r <br />Mere h uth.
