RESOLUTION NO. 22 <br />SERIES 2023 <br />A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT <br />BETWEEN THE CITY OF LOUISVILLE AND THE CITY OF LAFAYETTE <br />REGARDING THE E-BIKE PILOT PROGRAM <br />WHEREAS, the City of Lafayette and the City of Louisville have each launched a <br />pilot program to promote e-biking as a primary form of transportation within the Lafayette <br />and Louisville communities; and <br />WHEREAS, the pilot programs will offer rebates to participating bike retailers in <br />exchange for the retailers' sale of Class 1 and Class 2 e-bikes to Lafayette and Louisville <br />residents at prices discounted to the amount of the rebate; and <br />WHEREAS, for efficiency's sake, Lafayette is willing to administer Louisville's pilot <br />program in addition to administering its own program, in accordance with the terms of the <br />"Intergovernmental Agreement Between the City of Louisville and the City of Lafayette <br />Regarding the E-Bike Program" and Exhibit A attached thereto (together, the <br />"Agreement"), which are attached to this resolution and incorporated herein; and <br />WHEREAS, C.R.S. §§ 29-1-201 et seq., authorizes the City of Lafayette and the <br />City of Louisville to cooperate and contract with one another with respect to functions <br />lawfully authorized to each of them; and <br />WHEREAS, the functions described in the attached Agreement are lawfully <br />authorized to the City of Lafayette and the City of Louisville, which perform such functions; <br />and <br />WHEREAS, the City of Louisville desires to enter into the Agreement with the <br />City of Lafayette to confirm their intent with respect to their a -bike rebate pilot programs. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />Section 1. The Intergovernmental Agreement, between the City of Lafayette <br />and the City of Louisville for implementation of the E-Bile Pilot Program, is hereby <br />approved. <br />Section 2. The Mayor and City Clerk are hereby authorized to execute the <br />Agreement, and the Mayor is hereby further authorized to negotiate and approve such <br />revisions to the Agreement as the Mayor determines are necessary or desirable for the <br />protection of the City, so long as the essential terms and conditions of the Agreement <br />are not altered. <br />Resolution No. 22, Series 2023 <br />Page 1 of 2 <br />
