ORDINANCE NO. 1432 <br />SERIES 2003 <br /> <br />AN ORDINANCE AMENDING CHAPTER 3.20 OF THE LOUISVILLE MUNICIPAL <br />CODE TO IMPOSE THE CONTINUED OPEN SPACE SALES AND USE TAX AS <br />APPROVED BY THE VOTERS AT THE NOVEMBER 5, 2002 ELECTION <br /> <br /> WHEREAS, pursuant to voter approval, the City in 1994 commenced imposition of a <br />temporary ~A % sales and use tax increase for the acquisition of land for open space buffer zones, <br />trails, wildlife habitats, wetlands preservation and future parks, which tax was approved for a <br />ten-year period; and <br /> <br /> WHEREAS, pursuant to Ordinance No. 1395, Series 2002, the City referred to the <br />voters and the voters approved a TABOR ballot issue to continue such 3/8 % sales and use tax <br />increase for an additional ten-year period, with the net proceeds of such sales and use tax to be <br />collected, retained and spent exclusively for the acquisition of land in and around the City of <br />Louisville for open space buffer zones, trails, wildlife habitats, wetlands preservation and future <br />parks; and for the development, construction, operation and maintenance of such open space <br />zones, trails, wildlife habitats, wetlands and parks; and <br /> <br /> WHEREAS, the City Council by this Ordinance desires to amend the Louisville <br />Municipal Code to impose such continued open space sales and use tax as approved by the voters <br />at the November 5, 2002 election. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. Subsection A of Section 3.20.200 of the Louisville Municipal Code, <br />regarding the sales tax levy, is hereby amended to read as follows (words added are underlined: <br />words deleted are ............... <br /> <br />Sec. 3.20.300. Levy of tax; rate. <br /> <br />A. There is hereby levied, and there shall be collected and paid, a sales tax <br />equal to three percent of the purchase price of tangible personal property at retail <br />or the furnishing of services, except that for the ten-year period beginning on <br />January 1, 2004-1-994, the amount shall be 3% percent of the purchase price <br />thereof, ; ...... ~ ...... ,+~. c~.~; ..... ~ ~ la r~;~ ~on2,~ ........ .~ ~.., +k.. <br /> <br /> Section 2.
