ORDINANCE NO. 1421 <br />SERIES 2003 <br /> <br />AN ORDINANCE AMENDING VARIOUS PROVISIONS OF THE LOUISVILLE <br />MUNICIPAL CODE TO ADDRESS WATER TAP FEES AND USE TAX OBLIGATIONS <br />FOR SENIOR INDEPENDENT LIVING UNITS <br /> <br /> WHEREAS, the City Council has determined that it is appropriate to revise certain <br />provisions of the Louisville Municipal Code to create a separate classification of residential use, <br />referred to as "senior independent living units" for purposes of calculation of water tap fees and <br />residential use taxes; and <br /> <br /> WHEREAS, the City Council finds and determines that such a separate classification is <br />appropriate for senior independent living units, as defined herein, as such units have been <br />demonstrated to have reduced occupancy, water usage, transportation impacts, and impacts on the <br />local schools, which make such types of units materially different than other types of residential use <br />categories currently established in the City water and use tax ordinances; and <br /> <br /> WHEREAS, the water tap fee and residential use tax obligations established by this <br />ordinance for senior independent living units are intended to apply solely to such units as defined <br />herein, and the City Council finds and determines that such provisions are not suitable for any other <br />type of residential use currently established in the City water and use tax ordinances; and <br /> <br /> WHEREAS, the City is authorized by its home rule charter and state law, including but <br />limited to C.R.S. §31-15-708 and C.R.S. §31-35-101 et seq. to regulate the use of the City water <br />system, to establish the requirements for use of such system, and to amend its residential use tax <br />requirements. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. Section 13.12.020 of the Louisville Municipal Code is amended by the <br />addition of a new Subsection F, and subsections C, D and E of such Section 13.12.020 of the <br />Louisville Municipal Code are hereby amended, to read as follows (words added are underlined; <br />words deleted are ~): <br /> <br />Sec. 13.12.020. Tap fee Generally. <br /> C. The amount of the tap fee for residential units shall be determined <br />by the city and shall be based upon the size of the tap, as calculated pursuant to <br />the provisions of the Plumbing Code adopted by the City and set forth in Title 15, <br />as then in effect, and by reference to the table of fees established by the city <br />administrator in accordance with section 13.12.040; provided, however that: (1) <br />the minimum tap fee paid for each multifamily unit other than a townhouse= after <br />payment in full for the first tap issued= shall be 60 percent of the existing charge <br />for a three-quarter-inch tap; (2) and pre, vialed t~at the minimum tap fee paid for <br />each townhouse in a group of attached "townhouses", as defined in Code section <br /> 1 <br /> <br /> <br />
