<br />AN ORDINANCE REPEALING THE PROHIBITION ON PIT BULLS CONTAINED IN
<br />SECTION 6.12.160 OF THE LOUISVILLE MUNICIPAL CODE
<br />WHEREAS, the City of Louisville (the "City"), is a Colorado home rule municipal
<br />corporation duly organized and existing under laws of the State of Colorado and the City
<br />of Louisville Home Rule Charter (the "City Charter"); and
<br />WHEREAS, by Ordinance No. 1143, Series 1994, adopted on March 1, 1994, the
<br />City Council enacted regulations concerning pit bull dogs including a prohibition on the
<br />ownership, possession, keeping, exercising control over, maintaining, harboring,
<br />transporting, or sale of pit bull dogs within the City; and
<br />WHEREAS, in addition to this broad prohibition on pit bull dogs, Section 6.12.020 of
<br />the Louisville Municipal Code prohibits any person from owning, keeping, harboring or
<br />possessing any vicious animal anywhere in the City, subject to certain defenses and
<br />exemptions; and
<br />WHEREAS, the City Council finds the general prohibition of vicious animals
<br />contained in LMC § 6.12.020 is sufficient to protect the health, safety and welfare of the City
<br />and its residents, and that prohibiting any specific breed of dog is unnecessary and overly
<br />restrictive.
<br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
<br />OF LOUISVILLE, COLORADO:
<br />Section 1. Section 6.12.160 of the Louisville Municipal Code (Pit bulls prohibited)
<br />is hereby repealed.
<br />Section 2. If any portion of this ordinance is held to be invalid for any reason,
<br />such decision shall not affect the validity of the remaining portions of this ordinance. The
<br />City Council hereby declares that it would have passed this ordinance and each part
<br />hereof irrespective of the fact that any one part be declared invalid.
<br />Section 3. The repeal or modification of any provision of the Municipal Code of
<br />the City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change
<br />in whole or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have
<br />been incurred under such provision, and each provision shall be treated and held as still
<br />remaining in force for the purpose of sustaining any and all proper actions, suits,
<br />proceedings, and prosecutions for the enforcement of the penalty, forfeiture, or liability, as
<br />well as for the purpose of sustaining any judgment, decree, or order which can or may be
<br />rendered, entered, or made in such actions, suits, proceedings, or prosecutions.
