ORDINANCE NO. 1396 <br />SERIES 2002 <br /> <br />AN ORDINANCE REPEALING AND REENACTING CHAPTER 8.56 OF THE <br />LOUISVILLE MUNICIPAL CODE, ENTITLED "SMOKING IN PUBLIC PLACES <br />PROHIBITED", AND INCLUDING PROVISIONS TO PROHBIT SMOKING IN <br />INDOOR PUBLIC PLACES AND OUTDOOR EATING AREAS <br /> <br /> WHEREAS, the City Council desires to repeal and reenact the City's smoking <br />restrictions as currently codified in Chapter 8.56 of the Louisville Municipal Code. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. Chapter 8.56 of the Louisville Municipal Code, entitled "Smoking in <br />Public Places Prohibited," is hereby repealed and reenacted to read as follows: <br /> <br />Chapter 8.56 <br /> <br />SMOKING IN PUBLIC PLACES PROHIBITED <br /> <br />Sec. 8.56.010 <br />Sec. 8.56.020 <br />Sec. 8.56.030 <br />Sec. 8.56.040 <br />Sec. 8.56.050 <br />Sec. 8.56.060 <br /> <br />Intent; effective date. <br />Definitions. <br />Prohibitions. <br />Signs. <br />Responsibilities of proprietors. <br />Enforcement. <br /> <br />Sec. 8.56.010. Intent; effective date. <br /> <br /> In order to protect the public health, safety, comfort and general welfare, <br />and because tobacco smoke is a positive danger to health, it is the declared <br />purpose of this chapter to prohibit smoking in areas which are used by or open to <br />the public unless such areas are permissible smoking areas pursuant to this <br />chapter. The provision of this chapter are effective October 8, 2002. <br /> <br />Sec. 8.56.020. Definitions. <br /> <br /> For the purposes of this chapter the following terms, phrases, words, and <br />their derivatives shall have the meanings given in this section, except where the <br />context clearly requires a different meaning: <br /> <br /> Common area means a lobby, hallway, elevator, restroom, or other <br />enclosed, indoor area where the public is likely to gather in close proximity. <br /> <br /> <br />
