ORDINANCE NO. 1396 SERIES 2002 AN ORDINANCE REPEALING AND REENACTING CHAPTER 8.56 OF THE LOUISVILLE MUNICIPAL CODE, ENTITLED "SMOKING IN PUBLIC PLACES PROHIBITED", AND INCLUDING PROVISIONS TO PROHBIT SMOKING IN INDOOR PUBLIC PLACES AND OUTDOOR EATING AREAS WHEREAS, the City Council desires to repeal and reenact the City's smoking restrictions as currently codified in Chapter 8.56 of the Louisville Municipal Code. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. Chapter 8.56 of the Louisville Municipal Code, entitled "Smoking in Public Places Prohibited," is hereby repealed and reenacted to read as follows: Chapter 8.56 SMOKING IN PUBLIC PLACES PROHIBITED Sec. 8.56.010 Sec. 8.56.020 Sec. 8.56.030 Sec. 8.56.040 Sec. 8.56.050 Sec. 8.56.060 Intent; effective date. Definitions. Prohibitions. Signs. Responsibilities of proprietors. Enforcement. Sec. 8.56.010. Intent; effective date. In order to protect the public health, safety, comfort and general welfare, and because tobacco smoke is a positive danger to health, it is the declared purpose of this chapter to prohibit smoking in areas which are used by or open to the public unless such areas are permissible smoking areas pursuant to this chapter. The provision of this chapter are effective October 8, 2002. Sec. 8.56.020. Definitions. For the purposes of this chapter the following terms, phrases, words, and their derivatives shall have the meanings given in this section, except where the context clearly requires a different meaning: Common area means a lobby, hallway, elevator, restroom, or other enclosed, indoor area where the public is likely to gather in close proximity.
