RESOLUTION NO. 12 SERIES 2002 A RESOLUTION ACCEPTING A QUIT CLAIM DEED TO CERTAIN PROPERTY TO BE USED IN CONNECTION WITH THE LOUISVILLE RESERVOIR REHABILITATION PROJECT WHEREAS, the City is undertaking the Louisville Reservoir Rehabilitation Project, which Project includes embankment construction and other activities; and WHEREAS, in order to accomplish the embankment construction, the City desires to acquire from the City of Lafayette a parcel of land totaling 0.146 acres, more or less, lying adjacent to the east side of the existing Louisville Reservoir within the City of Louisville, and more particularly described in Exhibit A to the deed attached hereto (hereinafter the "Property"); and WHEREAS, it has been proposed that Lafayette convey the Property to Louisville in consideration of Louisville previously providing approximately one-half million gallons of treated water to Lafayette on an emergency basis, without further consideration for the Property; and WHEREAS, the City by this Resolution desires to approve the acquisition of the Property and state its acceptance of the conveyance thereof. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. The City Council of the City of Louisville, Colorado hereby approves the acquisition from the City of Lafayette of the Property more particularly described in Exhibit A to the Quit Claim Deed attached hereto and incorporated herein by reference, and hereby accepts such Deed for conveyance of the Property. 2. The Mayor, City Manager and City Staff are authorized to execute all documents and do all other things necessary on behalf of the City to effect the City's ownership of the Property.
