RESOLUTION NO. 6 <br />SERIES 2002 <br /> <br />A RESOLUTION APPROVING THE FIRST AMENDMENT TO THE U.S. <br />36 CORRIDOR COMPREHENSIVE DEVELOPMENT PLAN <br />INTERGOVERNMENTAL AGREEMENT AMONG THE CITY OF <br />LOUISVILLE, THE CITY OF BOULDER, THE TOWN OF SUPERIOR <br />AND THE COUNTY OF BOULDER, COLORADO. <br /> <br /> WHEREAS, the City of Louisville, the City of Boulder, the Town of Superior and the <br />County of Boulder, Colorado are parties to the U.S. 36 Corridor Comprehensive Development Plan <br />Intergovernmental Agreement, dated June 20, 2000 (hereinafter the "Agreement"); and <br /> <br /> WHEREAS, the parties desire to amend the Agreement in the manner provided in the <br />proposed First Amendment attached hereto; and <br /> <br /> WHEREAS, the City is authorized to execute the proposed First Amendment pursuant to <br />C.R.S. ' 29-20-101 et seq., which authorizes the parties to cooperate and contract with each other <br />for the purpose of planning and regulating the development of land by means of a "comprehensive <br />development plan"; and <br /> <br /> WHEREAS, pursuant to C.R.S. ' 29-20-105, the City Council has held a public hearing on <br />the proposed First Amendment after proper notice; and <br /> <br /> WHEREAS, the City Council finds that the proposed First Amendment is in the best <br />interests of the City and its citizens. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br /> 1. The proposed First Amendment to the U.S. 36 Corridor Comprehensive <br />Development Plan Intergovernmental Agreement, a copy of which First Amendment is attached <br />hereto and incorporated herein by this reference, is hereby approved. <br /> <br /> 2. The Mayor is hereby authorized to execute the attached First Amendment to the <br />U.S. 36 Corridor Comprehensive Development Plan Intergovernmental Agreement on behalf of the <br />City Council of the City of Louisville, except that the Mayor is hereby further authorized to <br />negotiate and approve such revisions to the First Amendment as the Mayor determines are <br />necessary or desirable for the protection of the City, so long as the essential terms and conditions of <br />the Amendment are not altered. <br /> <br />PASSED AND ADOPTED this 5th day of March, 2002. <br /> <br />Tom Davidson, Mayor <br /> <br /> <br />
