<br />RESOLUTION NO. 20 <br />SERIES 2002 <br /> <br />A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE STATE OF <br />COLORADO DEPARTMENT OF TRANSPORATION AND THE CITY OF LOUISVILLE <br />FOR MAINTENANCE OF TRAFFIC CONTROL DEVICES <br /> <br />WHEREAS, an agreement has been proposed between the Colorado Department of <br />Transportation and the City of Louisville for the maintenance by the City of the traffic control <br />devices located at the intersection of State Highway 42 and South Boulder Road; and <br /> <br />WHEREAS, the City is authorized to enter into such agreement pursuant to state law, <br />including but not limited to C.R.S. Sections 29-1-201 et seq. and 43-2-103; and <br /> <br />WHEREAS, the City Council finds that the proposed agreement is in the best interests of <br />the City and its citizens. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br />1. The proposed Contract between the State of Colorado, for the use and benefit of the <br />State Department of Transportation, and the City of Louisville for maintenance by the City of <br />traffic control devices at the intersection of State Highway 42 and South Boulder Road is hereby <br />approved in essentially the same form as the copy of such Contract accompanying this Resolution. <br /> <br />2. The Mayor is hereby authorized to execute the attached Contract on behalf of the <br />City Council of the City of Louisville, except that the Mayor is hereby granted the authority to <br />negotiate and approve such revisions to said Contract as the Mayor determines are necessary or <br />desirable for the protection of the City, so long as the essential terms and conditions of the Contract <br />are not altered. <br /> <br />3. City Staff is hereby authorized and directed to perform all actions and execute all <br />documents necessary to effectuate the Contract and perform the City's obligations thereunder. The <br />Director of Public Works is hereby authorized to execute any Contract change orders and any <br />contract funding increase/decrease and approval letters that may be necessary or required in <br />connection with such Contract. <br /> <br />PASSED AND ADOPTED this 18th day of June, 2002. <br /> <br />--;;;12~ <br /> <br />1 <br />
