RESOLUTION NO. 19 <br /> SERIES 2002 <br /> <br /> A RESOLUTION APPROVING A <br /> FINAL PUD DEVELOPMENT PLAN <br />FOR AVISTA ADVENTIST HOSPITAL <br />PROFESSIONAL OFFICE BUILDING II AND <br />AMBULATORY SURGICAL CENTER <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of final PUD development plan for an 86,200 square foot, one and two-story <br />expansion to the existing Avista Adventist Hospital, for professional offices and an ambulatory <br />surgical center; and <br /> <br /> WHEREAS, all materials related to the final PUD development plan have been <br />reviewed by City Staff and the Planning Commission and found, with conditions, to be in <br />compliance with Louisville zoning ordinances (including the Avista General Development <br />Plan), sUbdivision regulations, the CDDSG, annexation and subdivision agreements and the <br />US 36 Corridor Comprehensive Plan IGA; and <br /> <br /> WHEREAS, after a duly noticed public hearing concerning said final PUD <br />development plan on May 14, 2002, where evidence and testimony were entered into the <br />public record, including the Staff Report dated May 14, 2002, the Planning Commission <br />recommended approval to the City Council, with conditions; and <br /> <br /> WHEREAS, City Council has reviewed the application and finds that the Planning <br />Commission recommended conditions have been addressed in the plans and written <br />correspondence submitted for City Council action and further finds that said final PUD <br />development plan should be approved, with the following conditions. <br /> <br />1. No building permit may be issued prior to the effective date of the proposed Health Park <br /> Subdivision Filing No. 6. <br /> <br />Prior to the issuance of an overlot-grading permit, the owner shall receive Council <br />authorization to conduct any activity within Tract A and shall execute a license <br />agreement in connection with such activities. <br /> <br />3. The PUD photometric plan shall be revised to reflect that fixtures in the westerly parking <br /> lot and drives befitted with shielding against US 36. <br /> <br />In compliance with the City's currently adopted water restrictions and landscaping <br />restrictions, the applicant shall follow the provisions as outlined the May 28, 2002 letter <br />which was sent out to all commercial and industrial building projects. <br /> <br /> <br />
