RESOLUTION NO. 23 <br />SERIES 2002 <br /> <br />A RESOLUTION APPROVING PURCHASE CONTRACTS TO BUY <br />AND SELL VACANT REAL ESTATE FOR PARK PURPOSES <br /> <br /> WHEREAS, the City of Louisville desires to acquire, for park purposes, approximately <br />3.323 acres of property owned by Marjorie Nell Pickett, Dorothy B. Pickett, and Harold Reginald <br />Smethills, Jr. (as personal representative); and <br /> <br /> WltEREAS, the property consists of three parcels that lie within unincorporated Boulder <br />County, in the Southwest One-Quarter of Section 8, Township 1 South, Range 69 West of the 6th <br />P.M., adjacent to and north of Spruce Street between the eastem and western ends of Walnut Street, <br />and in the vicinity of the Treehaven, McKinley Park and Louisville Heights subdivisions, as <br />depicted on the map accompanying this Resolution (the "Property"); and <br /> <br /> WltEREAS, the owners of the Property have stated their desire to sell the Property to <br />Louisville upon the terms and conditions of mutually-agreeable purchase contracts; and <br /> <br /> WltEREAS, three Purchase Contracts have been proposed with the owners for purchase of <br />the Property. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br /> 1. The three proposed Purchase Contracts to Buy and Sell Real Estate between the <br />City and Marjorie Nell Pickett, the City and Dorothy B. Pickett, and the City and Harold Reginald <br />Smethills, Jr., as personal representative, are hereby approved in essentially the same form as the <br />copies of such Purchase Contracts accompanying this Resolution. <br /> <br /> 2. The Mayor is authorized to execute the Purchase Contracts, except that the Mayor is <br />hereby granted the authority to negotiate and approve such revisions to said Contracts as the Mayor <br />determines are necessary or desirable for the protection of the City, so long as the essential terms <br />and conditions of the Contracts are not altered. <br /> <br /> 3. The Mayor, City Manager and City Staff are further authorized to do all things <br />necessary on behalf of the City to perform the obligations of the City under the Purchase Contracts, <br />and are further authorized to execute and deliver any and all documents necessary to effect the <br />purchase of the Property under the terms and conditions of said Purchase Contracts. <br /> <br />PASSED AND ADOPTED this 18th day of June, 2002. <br /> <br /> Davi~so-n, Mayor <br /> <br />1 <br /> <br /> <br />
