RESOLUTION NO. 21 <br /> SERIES 2002 <br /> <br />A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE WATER LEASE AND <br />EXCHANGE AGREEMENTS ON BEHALF OF THE CITY IN ORDER TO ENHANCE <br />CITY WATER SUPPLIES <br /> <br /> WHEREAS, the City Council finds that drought conditions within the Boulder Creek <br />drainage and State of Colorado are currently impacting and threatening the City's available water <br />supply; and <br /> <br /> WHEREAS, information available as of the date of this resolution indicates that available <br />snow pack and stream runoff conditions within Colorado may be worse than those observed in over <br />100 years; and <br /> <br /> WHEREAS, because of such drought conditions, the City Council finds it is necessary and <br />desirable to enhance the City's water supplies though the leasing and exchange of water rights as <br />such rights become available for lease or exchange; and <br /> <br /> WHEREAS, in order to permit the City to timely act on proposed leases and exchanges of <br />water, the City Council by this resolution desires to authorize the Mayor to enter into water lease <br />and exchange agreements on behalf of the City within the parameters set forth herein. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br /> 1. The Mayor is hereby authorized to execute on behalf of the City such water lease <br />and water exchange agreements as the Mayor determines are necessary or desirable for the <br />enhancement of the City's water supplies. Any such lease shall be at a rate no greater than $300 <br />per trait for lease of units within the Colorado Big Thompson Project, or an equivalent rate for other <br />water rights. A maximum of the equivalent of 500 units of Colorado Big Thompson Project water <br />may be secured pursuant to this Resolution. <br /> <br /> 2. All obligations of the City to make payment under any lease or exchange agreement <br />entered into pursuant to the authority set forth herein shall be subject to annual appropriation in the <br />sole and absolute discretion of the City Council of City of Louisville. <br /> <br /> 3. The Mayor, City Manager and City Staff are authorized to do all things necessary <br />on behalf of the City to perform the obligations of the City under any water lease agreement entered <br />into pursuant to this Resolution and to execute and deliver any and all documents necessary to <br />effect the lease of water under the terms and conditions of such leases. <br /> <br />PASSED AND ADOPTED this 18th day of June 2002. <br /> <br /> <br />
