RESOLUTION NO. 24 <br />SERIES 2002 <br />A RESOLUTION APPROVING A <br />FINAL SUBDIVISION PLAT <br />FOR THE LOVRIEN SUBDIVISION <br />WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a final subdivision plat for a single -lot, single-family subdivision, on 1.156 acres, <br />to be known as the Lovrien Subdivision; and <br />WHEREAS, all materials related to the final subdivision plat have been reviewed by <br />City Staff and the Planning Commission and found, with conditions, to be in compliance with <br />the Louisville zoning ordinances, subdivision regulations, and the Maurer Annexation <br />Agreement; and <br />WHEREAS, after a duly noticed public hearing concerning said final subdivision plat <br />on June 11, 2002, where evidence and testimony were entered into the public record, <br />including the Staff Report dated June 11, 2002, the Planning Commission recommended <br />approval to the City Council, with conditions; and <br />WHEREAS, City Council has reviewed the application and finds that the Planning <br />Commission recommended conditions have generally been met and the final subdivision plat <br />should be approved, with the following conditions: <br />I) The Conservation Easement discussed in the Annexation Agreement limiting the lot to <br />one (1) single-family development, shall be recorded with the plat after final <br />subdivision plat review by City Council. The Conservation Easement shall be subject <br />to review and approval by the Mayor, City Manager and City Attorney. Further, no <br />building permits shall be issued prior to the recordation of the plat. <br />2) The applicant shall agree to accept a revocable, non-exclusive access easement across <br />Outlot E, for installation of a driveway access to serve the property from its north <br />boundary to St. Andrews Lane as generally depicted on the Final Subdivision Plat for <br />the Lovrien Subdivision. <br />3) The applicant shall, prior to plat recordation, execute a Subdivision Agreement. <br />4) The driveway landscape plan shall be reviewed and approved by staff in conjunction <br />with and prior to the issuance of the first building permit. <br />5) It shall be noted that the public use dedication requirements from Section 16.16.060 of <br />the Louisville Municipal Code have been met in full through the dedication of Outlot A. <br />No additional cash payments are required for construction of trail improvements. <br />1 <br />
