RESOLUTION NO. 28 <br />SERIES 2002 <br /> <br /> A RESOLUTION APPROVING THE <br />HEALTH PARK SUBDIVISION - FILING NO. 6, <br />A FINAL SUBDIVISION PLAT <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of final subdivision plat for the Health Park Subdivision Filing No. 6; and <br /> <br /> WHEREAS, all materials related to the final subdivision plat have been reviewed by <br />City Staff and the Planning Commission and found, with conditions, to be in compliance with <br />Louisville zoning ordinances (including the Avista General Development Plan), subdivision <br />regulations, the CDDSG, annexation and subdivision agreements and the US 36 Corridor <br />Comprehensive Plan IGA; and <br /> <br /> WHEREAS, after a duly noticed public hearing concerning said final subdivision plat <br />on July 9, 2002, where evidence and testimony were entered into the public record, including <br />the Staff Report dated July 9, 2002, the Planning Commission recommended approval to the <br />City Council, with conditions; and <br /> <br /> WHEREAS, City Council has reviewed the application and finds that the Planning <br />Commission recommended conditions have been addressed in the plans and written <br />correspondence submitted for City Council action and further finds that said final subdivision <br />plat should be approved, with the following conditions: <br /> <br />Prior to the issuance of an overlot-grading permit, the owner shall receive Council <br />authorization to conduct any activity within Tract A and shall execute a license <br />agreement in connection with such activities. <br /> <br />2. Prior to, or in conjunction with plat recordation, the owner shall execute and record an <br /> amended Health Park Subdivision Agreement. <br /> <br />3. The applicant shall provide evidence of 'permission to grade 'from CDOT prior to <br /> commencing off-site grading. <br /> <br /> <br />
