RESOLUTION NO. 16, <br />SERIES 2001 <br /> <br /> A RESOLUTION APPROVING A <br />SPECIAL REVIEW USE APPLICATION FOR PUBLIC SERVICE <br />COMPANY OF COLORADO (PSCo) <br /> <br /> WHEREAS, there has been submitted to the City Council of the City of <br />Louisville a request for approval of a Special Review Use (SRU) from Xcel Energy to <br />upgrade an existing, above ground, 115 kilovolt (KV) electric transmission line located <br />within the City of Louisville; and <br /> <br /> WHEREAS, the Louisville Planning Commission held a duly-noticed public <br />hearing on the SRU request on April 11, May 9, and June 13, 2000, at which the <br />applicant and interested parties presented testimony and other evidence, and at which <br />numerous documents were made a part of the record; and <br /> <br /> WHEREAS, the Planning Commission on June 13, 2000 adopted Resolution No. <br />12, Series 2000, recommending disapproval of the Special Review Use to rebuild the <br />existing, above ground, 115 KV electric transmission line; and <br /> <br /> WHEREAS, the Planning Commission's recommendation was forwarded to City <br />Council, which considered the proposed SRU at its July 18, August 15, and September 5, <br />2000, meetings, at which the applicant and interested parties presented testimony and <br />other evidence, and at which numerous documents were made a part of the record; and <br /> <br /> WHEREAS, on September 19, 2000, the City Council remanded the application <br />back to the Planning Commission with the direction that the Planning Commission <br />further evaluate rerouting alternatives for the proposed upgrade, as well as pole types for <br />the proposed rebuild within the existing right-of-way; and <br /> <br /> WHEREAS, on December 12, 2000, and January 9, 2001, the Planning <br />Commission conducted a duly-noticed public hearing for the purpose of receiving new <br />information and testimony on rerouting alternatives, as well as pole types for the rebuild <br />within the existing right-of-way; and <br /> <br /> WHEREAS, at the December 12, 2000, and January 9, 2001 hearings, the <br />applicant and interested parties presented testimony and other evidence on such matters <br />and other matters related to the SRU request, and numerous documents were made a part <br />of the record; and <br /> <br /> WHEREAS, the Planning Commission on January 9, 2001, adopted Resolution <br />No. 1, Series 2001, recommending disapproval of the proposed SRU; and <br /> <br /> WHEREAS, the City Council by this Resolution desires to set forth in findings, <br />conclusions and ruling with respect to the proposed SRU. <br /> <br /> <br />
